MR. CHARLES FUXMAN ACQUITTED

Mr. Charles Fuxman, proprietor of the Marcel Bar and Buffet, was acquitted at the Kowloon ̈ Magis- tracy yesterday afternoon of the charge against him of receiving stolen property, on the re-opening of the case for additional defence evidence.

In his finding, Mr. E. Himsworth stated that he was satisfied that the goods-661bs. beef and 29 kip pers-were removed from the Nan- king Barracks on June 28 in cir- cumstances which amounted to stealing, adding, later, "I can only infer from the evidence of the de- gree of control which and his servants exercised these goods that defendant' ́had taken them into his possession.

Defendant, however, argues that the possession, if any, was only temporary and that it was intended that the real owners of the pro- perty would take them away after they had finished their drinks.
