JUDGMENT RESERVED
Before the Full Court yesterday, Mr. Justice R E, Lindsell and Mr. Justice J. J. Hayden sitting, Mr. FC Jenkin, K.C brought an application for habeas corpus proceedings. o behalf of Tong Wan-kin, clias Tong Chan-mung challenging the validity of the action of the First Magistrate, Mr. W. Schofield in making a com-j mittal order against a fugitive! -offender on evidence which had not been subject to cross-examina- tion. The fugitive was alleged to have embezzled money from a pawnshop in Canton, of which "be was the managing partner.
After ging a resume of the previous proceedings before the First Magistrate, Mr. Jenkin sub- mitted that the Magistrate had -clearly misdirected himself by giving the benefit of the doubt to the prosecution instead of to his .client. Under the circumstances, he contended that the committal order should be quashed.
After Mr. J. A. Fraser, Assis- Jant Attorney General, had plied for the Crown, Mr. Justice Lindsell said the Court desired to take time to consider the matter and adjourned the case sine dic.

Lang's muti- lated body was found in a Hammond, Ind., dump and was identi- fied by his fiancee, Josephine McKinley. Mrs. Dunkel's nephew. Russell Anderson, was questioned when Miss McKinley charged that Anderson shadowed Lang at the request of Mrs. Dankel, who is said to have been in love with her former son-in-law.
