CASE AGAINST

A.-S.I. WALLER

Bribery Charge In Supreme Court,

POLICE OFFICER ACCUSED.

Startling discrepancies in the evidence of Ho Klu clies Ho Hong-sang were re- vealed during the cross- examination of the witness by Mr. Duncan McNeill, de fence counsel for Acting Sub-Inspector H. Waller,

whose trial on a charge of taking a bribe of 550, open- ed before the Chief Justice, Sir Josepa Kemp, „A.C., at the Supreme Court This morning.

The discrepancies pointed out. by Mr. McNeill are between the evidence given at the Summary hearing of the case and the evidence given this morning.

The charge against the accus- ed is that he took a bribe of $50 from Ho Kiu, a foki employed at the Po Wa Tong Medicine Shop, Taipo Market, on October 2, after the seizure of six taels of raw opium.

Mr. J. A. Fraser, Assistant Attorney-General appeared for the Crown and Mr. Duncan Me-- Neill, instructed by Mr. G. K. Hall Brutton appeared for the defendant.

The following jury was 'em- panelled: Messrs. A. H. Car roll (foreman), T. B. Wilson, F. F. Durtrich, D. S. V. Curtis,

P. S. R. Carnac, Au Ping-shamy, and Wong Katt-chiu.

Outlining the case, Mr. Fraser said that A. S: 1. Waller was sta tioned at Taipo Market Police Station.

It was alleged that about noon of October 2 accused was on). duty with a Chinese detective, Sing Sam. Accompanied by the detective, A. S. I. Waller went to the Po Wa Tong shop and en- tered by the rear door. There they found three men in a cubi- cie, one of whom was

The other two men then left the room and accused had a ta'k with the detective outside the

room.

The detective, Mr. Fraser said, would say that the accused said to him "$100 or $50,” and under- standing this to mean he was to ask for a bribe, the detective re- turned to the, room and said to Ho Kiu, "The Inspector will ar- rest you. He wants $100 or $50.” After this information had been passed to Ho Kiu, accused left the shop.

Mr. C. A. Grimes of the P.W.D. was called to the stand first to. prove the plans of the shop and Burrounding, district, He was fol- lowed by Dr. A. D. Wong, Aasiat- ant Medical Officer of the New Territories.
