-1,000 Years.

$2,000 OFFER REFUSED.

In the Summary Court yesterday afternoon, Mr. Justice R. E. Lind- sell heard an interesting case con- cerning the medicinal properties of fragrant cedar wood which is known to the Chinese as "pak {heung."

The plaintiff in the case was [Chan Sam, of 380, Hennessey Road, Wanchal, represented by Mr. D. B. Evans; and the defendant was Wong Lan-sang, manager ¡of the f Hong Kong Confectionary Co., of Wellington Street, represented by Mr. H. L. Dennys.

The plaintiff falled in his claim for recovery of the wand from the defendant because his Lordship held that the wood was worth more than $1,000, and was therefore out of Summary Jurisdiction.

Intended For Collin.

The wood, according to plaintiff's case, was owned by his father at the time of his death ́`in ~ April, 1923, and he had intended that his coffin should be. made of it. Un- known to plaintiff, the wood was sold to a boatman for $26 and It subsequently went into the posses- sion of the defendant. who paid $300, and later refused an offer of $2,000 for it. Plantill was claim- ing the wood as administrator of bis late father's estate.

Defendant did not deny that he bought the wood for $300, but questioned the plaintiff's right to

It.

The defendant also called Chinese doctor who stated that there were 35 different species of medicinal wood used in Chinese. medicine, and of these, the most valued was "pak heung", because it could cure a hundred kinds of diseases. It was a rare wood and was not stocked in Hong Kong, It might be possible to get the wood from coffin shops in Canton. The last time that witness had tasted this kind of wood was in 1917.

Judgment for Defendant,

His Lordship, after hearing the evidence of a third Chinese doctor, decided that the wood was worth more than $1,000 and was, there fore, out of Summary Jurisdiction. Therefore he gave judgment for defendant with coats on the $500 to $1,000 scale.

Mr. Evans did not apply for the case to be transferred to Original Jurisdiction.
