THREE-CARD TRICK
MAGISTRATE DISCUSSES GAMES OF SKILL AND CHANCE.
An interesting ruling on the three-card trick was given recent- ly by Mr. Oulton, the Tower Bridge magistrate.
Edward Charles Marshall, of Park-grove, Leyton, Essex, Harold Coleman, of Southampton Street, Camberwell, S.E., and Robert Ward, of Dongola Road, Plaistow, E., were charged under the Gaming Act with working the three-card trick on a member of the R.A.F. in a train between Woking and Waterloo. They were also charged under the railway company's by-laws, with entering [a railway carriage for gaming. There was a third charge under the Vagrancy Act, with playing ja game of chance.
Dealing with the third charge, Mr. Oulton said:
"To secure
a conviction the prosecution must prove that the game was a game of chance. The three-card trick has been held to be a game of skill The fact that the defendants,, by im proper methods, induced the com- plainant to play the game, does not alter its character. Does the fact that a card was marked do so? and if so, does it become a game of chance?
"I have no hesitation in answer- ing the first question in the affirmative. If the dealer ex- hibited į plain card for the pic- ture card it would cease to be a game of skill.
"So, also, if one of the party to the game be prevented from exer cising his skill by the other party, then, as in this case, the game is no longer one of skill. Does the game then become one of chance? I think not.
"It is now no more a game of chance than it is of skill. Two birds have been killed with one stone. - Skill and chance have been slain by certainty. The marked card is certain to he backed and the backer is certain to lose.
