MR. I. BREWER'S CASE
ADDRESS BY DEFENDING SOLICITOR
DECISION RESERVED
The Magistracy proceedings against Mr. Noel Instone Brewer, who is charged under the Perjury and Lar reny Ordinances in connection with the preparation and Aling of balance sheet of the Instone Banking Corporn. tion, concluded on Tuesday afternoon, and Mr. A. W. G. H. Grantham re zorved his decision.
Prior to Mr. E. Davidson's submis- sions for the defence, the Magistrate asked Mr. Brawer whether, having heard the evidence, he wished to make
statement, warning him that al though he was not obliged to say any thing, any statement he would like to make would be taken down as evid ence. Mr. Browor replied that he did not wish to say anything.
Hore, in 1921, Dutch coal-mining company, called the Maatschappij tot Alijnbouwkun- dige Werken, of South Limburg, frat began dellling operations and trans- ferred this work later to the Kilo. niale, who continued drilling to depth of 850 metres.

traces, with a little heavy of, were found, but no o reservoir was pierced, and this area was abandoned after 1921.
The fact that these once abandoned areas are again being thoroughly in vestigated for seems to justify the belief that there is all here in com- mercially exploitable quantities. The latest drilling methods, and desp boring machinery, tead, so experts opine, to facilitate the discovery of all at hitherto impossible depths. Sandakan Light And

The report for prosentation to the shareholders at the seventh ordinary early meeting to be held at the Head Office of the Company, St. George's Building, on Tuesday, at 12.30 p.m., is as follows:

Duty of the Prosecution The defendant was charged with
etatement false in a material particu having knowingly and wilfully made
Inr in connection with the statutory report and balance sheet, the charges being all the same. It was part of the burden of the prosecution therefore to prove the state of the defendant's mind. Not only must the
prove that the statement are untrue but they must prove that Mr. Brewer knew them to bo untrue.
There were two important points to remember. It had been very fairly stated by Mr. Fitzroy that the defen- dant defrauded nobody in the balance sheet. Mr. Brewer had not made a cent out of it. In support of the charges, the principal evidence called has been that of Mr. S. H. Ross and Mr. E. L Agassiz. Throughout their evidences it. was clear that what they were stating were matters of opinion.
In the course of his submissions, Mr Davidson went through the charges separately, quoting a number of Home authorities. He said that so far A the evidence goes there was not the faintest evidence to support the charge of perjury. Mr. Ross had stated that
the aasuming
transactions were
genuine, they were correctly treated in the statutory report. This statement put an end to the charge.

An “Amazing Witness"
It was amazing, he continued, that of the witnesses against Mr. Brewer was an auditor, Mr. Li Tung, who is authorised by law to sign balance sheets. That witness was na
Brewer if any perjury has been com- guilty far more guilty than Mr. mitted at alt by the defendant.
At a later stage Mr. Davidson sald there was no evidence that Mr. Brewer prepared the balance sheet. Mir. Brewer was unfortunate in that all he had said at the public examination was now being used against him.
Mr. Brewer was not the book-keeper of the Company but its President.
In conclusion, Mr. Davidson submit- ted that this was one of the cases which should not be sent before a jury and Mr. Brower had a right to be dis- charged in Court.
Mr. Fitzroy dealt with points of law, quoting authorities for his Worship'
guidance. Decision was then reserved until next Tuesday at 11.80 a..
