How in American naval officer and many naval ratings of the same nationality crowded a motor-boat to carry them back to their vessel, and how before this was permitted the Chinese coxswain of the, motorboat entered into an agreement with the naval officer to take full respon- sibility of any trouble that might arise, was related at the Marine Court this morning when the boxswain of motor-lost." Whampoa II" was charged before, the Hon. Commander G. F. Hole with carry- ing: 10 passengers in excess to that permitted in his license (29) on Sept. 12.
Including the American officer, there were 29 other sailors in the boat.
The accused, in a statement, said that he had agreed with the officer that should any trouble arise as a result of over-loading his motor boat to such an extent, the latter would take full responsibilty. The officer agreed to this.
As it was, the police arrived on the soone, and subsequently nocused made his appearance before the Marine Magistrate.
After palias evidence had been taken, Hie Worship said that he could not secept the accused's state. ment. The coxswain, His Worship pointed out, in any circumstances, was in full charge of his vessel and. therefore, was held responsible.
A fine of $50, with the alterna- tive of one month's jail, was posed.
