Sanitary Inspector Foster this FIVE POWERS STILL DISCUSSING

morning summoned Mr. A, S. Gubbay, before Mr. T. M. Hazlerigg, at the Central Magistracy, charging him, as landlord of No. 11, Woo Hop.street, with allowing the basement. of the premises to be used as a workshop where people were also alleged to have slept at night, contrary to regulations with regard to the use of basements as stores only.

Mr. Gubbay admitted to M. Hazlerigg that he was landlord of the premises, and that à Chinese named Poon Fook was the tenant, He said that he was surprised when he receiv ed the summons, because he had no right of entry, and had no control over the premises. Poon Fook had appar ently sub-let the basement to another person, but that was without his (Mr. Gubbay's) knowledge or consent.

Mr. Hazlerigg told the Inspector that he was inclined to the view that a Jandlord could not be held liable. For example, if a tenant used certain pre- mises as a gambling house, the land- lord was not liable.

Inspector Foster said that it was the duty of owners of house to see to it that basements were not used as anything but stores. Messra. E. D. Sassoon & Co., Ltd. had heen warned by the Sanitary Department that the base ment of this particular house could not be used for any other purpose bat stor

When Duty Discharged

Mr. Hazlerigg said that if it could be shown that, the landlord, had pass- ed on the warning to the tenant when letting the premises, he had discharged his dety under the Ordinance.
