How accused attacked his two sisters with a board, which was lying loose amidships, and also with a knife was described by the boy. After striking his second sister accused attacked him, grasping-him-by-the-throat;-and- with a knife struck him on the side of the head. In the struggle he fell over the side of the dinghy into the water. After again cut- ting him on the wrist accused rowed to the shore. He (witness) swam about for some time before being picked up by a sampan.

Previous to the boy's evidence, Tang Tak-hi, înterpreter at the Central Police Station, gave evid- ence of reading the charge of murder to accused. He read it in the Punti dialect He also took down a statement made by ac cused, which was signed by the lalter with a cross mark.

Mrs. Mercer appealed from the judgment of Mr. Justice Eve in the Chancery Division, who de- cided that Mrs. Mary Ann Smalley was entitled to succeed.

Lord Hanworth, giving judg ment, said that the name "Eliza" could not be mistaken for "Mary." By repute Eliza was Mr. Smalley's wife, and therefore the word "wife" could be used in a second- ary meaning. Lord Hanworth thought that the intention of Mr. Smalley was to give his estate to Mrs. Mercer, and the appeal would be allowed.

Lords Justices Lawrence and Russell concurred.
