Sgt. McLeod also said that he kept to his left, at the same time applying the brakes and the acci- dent occurred just on his own side of the road. It was not true that he swerved to his wrong side. His turn from the police, station could be done within a radius of 20 to 26 feet and the road was 70 feet wide.

The only explanation he could give for the accident was that Mr. Brett mistook his signal and thought he was going to turn down a side street and conse quently swerved over to the wrong side of the road.

Sgt. Nolan, who was riding pil lion on St. McLeod's motor cycle, also gave evidence.

His Lordship said he had. not the slightest doubt that Mr. Brett's story was the more likely

one.

Mr. M. K. Lo appeared for Mr. Brett and Mr. C. A. S. Russ for Sgt, McLeod.

Reports from the Middle Moselle valley indicate that 1928 will be a remarkable wine year there, though the unfavourable weather in the spring destroyed much blossom..
