Mr. King, that on the request of the Court he produced a copy of a telegram delivered by his office. It was received on October 29 from Shanghai addressed to "Georgie King Edward Hotel," and delivered
on November 4.
Mr. King then produced a new paper announcing that a cable ad- dressed to "Georgie" was amongst the unclaimed telograms, and said that this announcement referred to the telegram in question.

Mr. King told the Magistrate that this "was a pinin telegram which had no bearing on the case.. It was, in fact, addressed to the Chief Officer of the 8.8. "Irene." He then referred the Magistrate to the left hand corner of the telegram: which there was an initial to a printed name which he would not mention.
Mr. Lindsell said that he did not sce why his attention should be: drawn to it at that time..
Mr. King said that he merely

Mr. Leask said that that only a matter of opinion. It bore
no weight at all as evidence.
Mr. King told his Worship that there was nothing to connect that name with the case. It was never mentioned.
Mr. Schnupel then went into the witness box. He said. in reply to Mr. King, that there was a cable address of "Khan Sahib" register-
equipment which he is liable under the Ordinance or rules to deliver up shall be liable to pay to the Commandant the value of the equipment. This appears to be defective in two points. In the first place, it is arguable that the section refers only to the final de- livery up by a member who is quitting the corps. In the second place, it may be important, as in the ease of a rifle or revolver, that the article should be returned to store and that the member should

Replying to another question, the witness said that he had been searching fur telegrams in the office that morning. He had paid particular attention to "forwarded messages," but he had not yet com- pleted a search of the "received messages." So far he had not found anything touching the mat- ters searched for.
Mr. Lindsell: The Great Northern Company has produced nothing yet?
Mr. King: No.
After consultation with Mr. Leask, Mr. King put in another telegram which he said was found amongst Christie's papers at Kow loon that morning. It had come through the Chinese Telegraph Administration, and was addressed to "Kahn Sahib."
.
"It is in code," "Mr. King said, "and I am putting it in by consent. if your Worship has no objection." Mr. Leask ingqired about the date of the telegram, and Mr. King announced that it was dated October 28,
Replying to his Worship. Mr. Leask said that he had no objection Lo the, telegram going in. In fact, It was one which he had expected from the Great Northern, and was looking for it.
Mr. Leask also intimated that he had no question to put to Mr. Schnapel, provided that the witness would appear in Court again if further telegrams were found.
Mr. King then announced that that closed the case for the the Great prosecution unière Northern Telegraph Company pro- duced other cables.
Mr. Lindsell said that he, under- stood that Mr. Lenak would like an adjournment.
Mr. Leask agreed. He wished for an adjournment in view of the documents which were found that morning which he had not had time to inspect in the presence of his clients. That opportunity would be afforded him that afternoon if his Worship would grant an adjourn- ment.
Mr. Lindsell then pointed out. that he would not be able to take the case again until the week after next and gave a week's formal remand until 10 a.m., on December 9, remarking that he would be pre- pared to hear the base again on the following Monday afternoon.
Mr. Lenak Intimated that he would require two full afternoons to complete hla defence, and his Worship fixed the afternoons of December 12 and 19 for the hearing of the defence.
