THE CHINA MAIL.
The marital troubles of a Chinese clerk and his wife form- ed the subject of an action before Mr. R. E. Lindsell yesterday when the wife claimed for maintenance.
It was the contention of the: husband that his wife had left Kim voluntarily following a quar- rel about her taking up Mah Jong. and playing it night after night, often stopping out late.
The wife alleged that the hus band had left her for another woman and referred to a "curly- haired gir in Pottinger Street with whom she alleged her hus- band was living.
The husband's reply was that this was merely platonic friend ship. The girl was the cousin of a friend of his.
The husband was examined as to his means and said his salary was $80 a month. He gave his mother $50 a month, he stated.
The legal point was raised as to whether an action could sue- cessfully be brought for neghi.. gence occurring two years, ago. The Home Act clearly laid down that such an action must be within six months of the alleged desertion. It was pointed out that the woman had brought the natter before the S.C.A. but His Worship, whilst finding that there had been desertion, ex- pressed doubt as to the extent of his powers to make an order.
A previous offer made by the husband to pay $750 for a final separation was referred to but defendant stated that this was, no longer open..
His Worship said he wouldı. adjourn the case whilst he thought the matter over. If he determined that he had power to make an order he would make one for $20 a month for the woman.

6. No responsibility is accepted for loss or delay in the post, All
letters should be registered and/or sealed.
