VESSEL RESPONSIBLE FOR SMORT DELIVERY.
A ship is liable for alert"delivery of, cargo set forth in the bill of lading, unless it can show that the missing cargo was in fact not ship- ped.
The Nutal (Dampskibe, Atk. Orient v. W. R. Grace & Co), de- elded by the US, Circuit Court of Appeals for the Ninth Circuit, 1928 PALM.C. 1235.
"This ense arose out of a shipment of bundles of Iron bare shipped by W. R. Grace & Co. from New York to Buenos Aire, by the s.a. "Natal." There was proef of delivery to the Veusel of the number of buncles re cited in the bill of lading, and also evidence that there was a shortage of 7 bundles in the delivery to the consignee.
It was contended that the ship had delivered all at the bundles it received, and was "therefore not Eliable. It appears. however, that there were shipments of steel on the same vessel to two other consignees and the court found that there pro- bably had been a misdelivery of the missing bundles to one or both of the consignees of the other ship- It was held that the vessel ment hud not sustained "the burden of. proof to show that the bill of lad- ing was erroneous or that the ves sel delivened all the cargo she re- ceived.
It was also contended that the ship was relieved from liability be- cause no written notice of claim for loss had been presented, as re- Pros-quired by the, bill of lading, at the

The court recognised the validity of the notice clase, citing a num- ber of cases in which similar I also clauses had been upheld. stated that mere knowledge on the part of the carrier at the time of delivery that there is a shortage did not relieve the consignee from mak- ing the enim within the prescribed time.
