The defendants," on arrival of the ship collected freight charges. Apr on a two per cent basis and it: was the return of the additional sum involved ($800.98), which the Feb. ship owner sued for. He claimed Mar that the defendants had gone out- side the powers specified in the (contract and were entitled to claimi

entrance and clearance fees only.

The case for the defendants was that the collection of freight was) outside the contract but that as agents they were entitled to colleef. Evidence could be called with 're- gard to cange and custom carried [on by shippers in such instances. The whole question was the reak intention of the parties under, a mercantile contract..

The case was adjourned
