MURDER TRIAL.
(To the Editor of the Ching Mgil).
Sir,-Arising out of the two murder trials in the Supreme Court this week, it strikes me as rather astonishing to find that very little or no interest is being. taken by the public when these criminal trials come up for, judg ment, I was a spectator in both of the trials and noted that in the Indian which two first case guards stood their trial for the murder of another guard, there. was only a fair number of their class as spectators, while in the second case when a Chinese stood his trial for the murder of an Indian policeman, neither Chinese nor Indians were in Court at all, those present were only witnesses and Police officers. I raise this matter because there is import- ance attached as far as our Jury I would System is concerned.
are strongly advise those who Jurors and especially those who have not been called for at any one time, that they should not ignore, the seriousness of their duty. They must not wait till called to know the procedure of their duty in Court: A man can- not possibly claim that he knows everything, and here I think I am in a safe position to refer to that well-known old saying that "a a dangerous little knowledge is thing," and my sympathy will not be extended to those who have no subject knowledge at 'all of a when full liberty is at their dis- posal to acquaint themselves of.
I was more than sutisfied to and that in both of the trials the fore- man of the jury in each case asked questions. In my opinion, I should say that it is indeed essen-
tial, as after all a Jury has as much right as the presiding judge
to cross-examine when evidence la not satisfying.. When I raised the question of Jury Reform in your columns of last year, you also had remarks made on the subject and you referred to the utter silence of jurymen during proceedings, but it is now pleas ing to note that a fault has been corrected and it is to be hoped. that for the sake of upholding the ue characteristics of British flaw and order, a foreman of jury should not fail to ask ques tions when the duty calls. There is another question which I should like to take up and that is the privilege that should be accorded to prisoners on trial- a seat in the dock even during the proceedings. The Court does not sit for a matter of an hour or two and to see a prisoner standing up all the while for days does arouse my sympathy, if not others. We know what mercy is and it is only right that we should act upon it." | Even God's mercy is solicited by the Judge for a murderer. That can rightly be said of what the trué version of British Justice is. Jurors, see that the right: course is to be taken!...
