the Chinese driver, who was sen- Conspicuous in his prison garb, tenced to three years' imprison- ment in respect of a collision at Castle Peak in April in which two people lost their lives, gave evid- ence this morning in respect of a previous collision on that road in which a bus driven by him, and a Ford car were concerned.
This collision occurred on March 10: the plaintills being the ownerg of the Ford car (the (Chang Mei Garage Company) and the defen dants the Chung Hing Motor bus Company. The claim was for $500, 1. MR. C. H. Lyson, represented the plaintiffs and Mr. 6. S. Huglas Jones the defendunts.

In the evidence of a seaman who, together with his wife and two infant children, was 'passen- ger in the car, it was alleged that. the bus in passing the car touched its front-right wheel und nudguard, the impact resulting in damage to that wheel at the axle.. The var swerved into the bank and the bus went on. In the opinion of this witness if the bus had been „Edn. of Australia going at reasonable speed it would have got past, without touch. ing. The Ford car had been hired by the witness for the trip round the New Territories. The collision overed as 'the vehicles were going up the hill at Tai Lau-ting village. To-day's Evidence.

Cross-examined by Mr. Angh Jones this witness said that it would not be right to say that in moving over to the left to make room for the bus to pass, the cor ran into the road of its own secord,
Mr. Hugh-Jones said his case was that the driver of the Ford ear had run into the side of the road before the bus passed. A slight impact, resulting in the rear right hand mudguard being bent, was admitted but the other damage, it was claimed, was the result of the action of the driver of the car. In any event, the claim was considered excessive.
Evidence in accordance with Mr. Hugh-Jones' opening statement was given by the driver of the bus, the conductor and á woman occupant.
