Mr. A. G. Mossop, instructed by the Consul-General, said this was the first instance of a person being charged under the Order in Coun* cil for returning from deportation. The British authorities in China regarded-such_return_as_a_very_ serious matter, but as this was the first case he was instructed not to press for such a term of imprison- ment as might be under the Order. He would simply ask for an order. for re-deportation. The history of the accused showed that he had engaged in sedition during war time.
Accused produced papers to show that he had received official permission to visit Hongkong, Canton and Shanghai, and said he told an official at Canton that he had been deported from Shanghai. He had not obtained permission to leave India. It was open to any one to come as far as Singapore without such permission...
The Magistrate pointed out that the only valid permission was that given by the Secretary of State, and as accused had
not this authority, he must make an order for his re-deportation.
