Mr. MacNamara: Yes, my lord. Mr. C. A. S. Russ, for the defence. said Mr. MacNamara's The first was points were two. that a notice to quit at Common Law either monthly or weekly could terminate at any time, and further that this being more than a month it was a good notice in Common Law. The second point was that even if it was not a good notice at Common Law the parti- cular wording of the Increase of Rents Ordinance made it suffi cient for the landlord to apply for possession after the Ordinance had been passed. He would deal first. with the question of whether the notice was good or bad. It was decided very early that in the case of a quarterly tenancy a quarter's notice was sufficient. That was in 1814 and the notice was ter- minable on the quarter day. But in the matter of monthly and weekly tenancies, it had never been definitely settled what length. Never of time was necessary, had it been suggested or thought possible that any person should terminate a tenancy in the middle of the period. It had never even been mentioned, ind the reason he considered was because no one ever doubted it. In their wildest nightmares the judges of the middle 19th. century never thought of it. It had always been taken for granted that these tenancies should not end in the
