Evidence was given by Sub-In- spector Bond, of the Water Police, to the effect that last Sunday after- Hon he saw rice and sugar being unloaded from the ship at the Queen Street wharf. The defendant's explanation to him was that he was unloading the cargo because the ship had been dangerously over- loaded.

Giving evidence, Captain Brown said he took on board 900 tons of i general cargo for Kongmoon which was loaded in 12 hours. The ship was not down to her nurk but when about 600 passengers came aboard on the Sunday afternoon with their baggage she went down below it. In consequence same rice and sugar had to be jettisoned.

The Marine Magistrate (Com- mander C. W: Bockwith, R.N.) asked Captain Brown why he did not send some off the passengers instead. The defendant replied that he had always found it a pretty hopeless proposition to try and turn Chinese aff once they got aboard. '

Commander Beckwith remarked that it seemed to him this miglit No happen on
