LAW OF SHIP DESERTION.

INTERESTING POINT.

The question of the powers veated in a court of summary jurisdiation in Fa case of desertion by a member of a crew duly signed on for a certain voy- age was referred to by the Liverpool Stipendiary Magietrate during the hearing of auch a charge against a man named William Mareland (28), who was in custody. for stealing cloth from the White Star liner "Baltic."

As a rule. cases of decertion are taken before the lay magistrates at Liverpool, but owing to the charge of Jarceny this case was dealt with by the Stipendiaty.

His Worship, with a view to as certaining. the penalties which wore allowed by the Merchant. Shipping Act, refrnd to the clause, which reads: "If a seaman lawfully engaged, or an apprentice to the sen service, commit any of the following offoacct he shall be liable to be pavished summarily as follows: 1 he deserts from his ship he shall be guilty of the offener at desertion and liable to forfeit all or any part of the effects, he leaves on board and the wages which be has then earned, and also, if the desertion takes place abroad, of the wagen he may eam in any other ship in which he may be employed until his return to the United King- dom, and to satisfy any exces of tɔ any aubstitute engaged in bis placent a higher rate of wages than the rate stipulated to be paid to him; and niso, except in the United Kingdom, he shall be liable to imprisonment for sty period not exceeding twelve wce e, with or without hard labour."

"What is meant by the remark "expect in the United Kingdom ?" asked his Worship. "It must mean ex- cept the desertion takes place in Eng land, for how could an Act of Parlis- meat give power to imprison any- where else than in the United. | Kingdom 1”

The Clerk to the Justices said there. was a ruling by the law officers as to what was to be done in such cases.. They-bad-advised he understood, that whether the desertion was committed here or abroad the imprisonment was. not legal in this country.

Inquiries, elicited the information that all the man was liable to forfeit was lia 3d wages due.
