THAT DIDN'T WORK.
When he resumed his seat on the Summary Court Bench this morning' after filling for a year the position of áeting. Chief Justice, Mr. Justice Gompert had to decide between the very widely divergent ac counts of a loan transaction given by an Indian waseylender called Surgin Singh and Ah Po, a Chinese chauffeur.
The Indian, who was represent- ed by M. Les Longinotto, claimed
payment of $112 under an LO.U! which he said the chanteur had given him Jast February. He said that the note Was written ont by an Indian watchman
bad wbo since left the Colony and that he handed the defendant $50 in cash. A watchman who claimed to have been present at the transaction but con fessed that he "could only read thumbmarks" was called to give corroborative evidence.
For the defence Mr. H. MacNamara called evidence to show that the 1.O.. was given not to the plairatif but to the plaintiff's brother and that the transaction took place in May of last year. A chanteur named Isa Khan said that he wrote the note and saw the plaintif's brother give the defendant $50. }
Mr. MacNamara explained that both the plaintiff and his brother went in 'for moneylending but only one of them--the plaintif was registered. He suggested that the unregistered brother handed the i 10C. to the plaintiff in order to induce the défendant to pay up.
His Honour found for the defendant and entered judgment in his favour with costs.TM
