COURT DISCUSSES BETTER FACILITIE

Magistrate Lindsell this morning heard the case in which Dr. S. Strahan was summoned for driving his car on the wrong aide of the road in Queen's Road Central on January.10.

Mr. D. H. Blake, who appeared for the defence, said that he was pre pared to enter a plea of "guilty" to a technical offence, He would like, however, to address the Court on cer- tain points in the case. Dr. Strahan, had no recollection of the offence alleged against him. The summons was served on him three days after the offence was alleged to have been committed. Counsel suggested that that was rather a long lapse. Dr. Strahan was constantly driving his car, carefully, he thought, and could not reasonably be expected to remember everything he did three According to the days past. summons, the offence was sup- posed to have been committed in Queen's Road and Counsel took it that it must have been in the vicinity of the Hongkong Cricket Club pavilion. Az Magistrate was doubtless aware, there was a rather, awkward curve on the tram lines opposite the Club, and in making that curve, à car was bound to be more or less on! the wrong side of the road. That was why be claimed the offence was a techdical one.

Mr. Blake said that. Dr. Straban had communicated with the Automo bile Association and he had been instructed to ask, "with all due consideration to the work entailed, that summonses in future be issued as soon as possible after the offence had been committed. In this case, Dr. Strahan had" his office in the heart of the town, and yet it took three days to serve him with the summons.

The Magistrate said that he was inclined to agree that three days was too long a time. He had read the -Association's letter to the C.S.P., and he thought the length of time asked for-24 hours was too short for a Would the place like Hongkong. Association agree to 48 hours as the limit?

Mr. Blake said that the Association did not presume to dictate to the police, but they were only suggesting that it would considerably help the defence if summonses were served as soon as possible.

Inspector Garrod said that in this case the application for the summons was made on the 11th, the morning after the offance was alleged to have been committed. If there was any delay, it must have been on the part of the server.

The Magistrate said, that was purely departmental matter and he did not wish to go into it.

Mr Blake said that he understood that in England summonses could be! issued within 24 hours, but of course, he appreciated the difficulty here, and was prepared to agree that 48 hours was reasonable.

Inspector Garrod said that it had been his practice in the past, as soon as an application for a summons was made to him, to ring up the person concerned and inform him. He had "discontinued this because on several occasions he had received very dis
