ALLEGED JAPANESE IMITATION,

In connection with a sale of soap, the Shi Chemng firm, of No. 10, Mercer Street, was this morning summoned at the Magistracy at the instance of M MJ.D. Stephens, solicitor, for infringing on the trade mark of F. J. Calvert, of Manchester and Bradford.

Mr. Stephens said that, having been empowered to institute proceed- ings against the defendants, he had seized 10 cases of soap bearing the infringed trade, park. The defendant had made a clear statement to him отв the subject, and had given

pame of a firm in Japan from which he said be had bought the soap. The defen dants were prepared to sign an under- taking before the Magistrate to des troy all the trade marks in question. Mr. Stephens added that he proposed to file that undertaking in Court.

The Magistrate said that it was not for the Court to decide a settle- ment between the parties concerned. He was willing to take it from the defendants that they were agreeable to'sign the undertaking and dismiss the summons.

The defendants asked for the return of the soap.

Mr. Stephens objected as the trade mark was heavily impressed on the soap.

The Magistrate ordered the forfei ture of the soap provisionally. If the defendants were able to find some means of melting it down, the soap would be returned to them.
