The question asked to be referred was whether in estimating the profits of the Madras branch of the Com- pany, two sums, £363,344 and £7,609 being excess profits and income tax paid at Home, should be deducted. The Company coptended that under the rules framed under the Income Tax Act they were entitled to the deduction. The Board of Revenue refused to refer on the ground that the application was after the award had been made and that the questing de pended entirely on the executive.orders of the Government and that no point of law was involved. Mr. Justice Kumaraswamy Sasori, while dismiss- ing the petition on the ground that it was put in after time, observed that the refusal of the Board of Revenue to refer, as the question depended on the executive orders of the Government, was untenable, as no executive order could over-ride the provisions of the Income Tax: Act or the rules made thereunder. The question raised involved points of doubt and difficulty and if the application had been made during the course of the proceedings, and had been rejected by the Board, His Lordship would have ordered the mandamus. There was no order 25 to costs.

The statement that Japanese are contemplating investment in the oil fields of Sumatra, and if they could only get the Government's financial assistance would invest ten million yen in exploitation of Dutch territory once more draws attention to the difference between Japan and other countries as regards land ownership. says the Japan Chronicle No such scheme would be possible on the part of foreign capitalists in this country. The mere suggestion would raise a storm of public protest. Yet the Japanese papers record the endea vours of Japanese capitalists to obtain control of Sumatra oil felds as if it was the most natural thing in the world. Great is the virtue of reciprocity in the abstract!

Another War Office communique states:-"The situation in the Shanghai, North China, Japan vs Naga.
