At H.M. Supreme Court, Shanghaly on July 9 belote the Registrar, Mi- G. W. King. Zung Ah-too, the SWI- pan man recently injured in the shoot- ing affair on the str. "Hanamet," brought an action agains: "Graham Bushby, found guilty of the shooting and sentenced to 18 months' impri- sonment, in recover $250 compensa tion.

Mr. M. B. Brown, who appeared for plaintiff, said there was a similar case in the Court in 1916, The poler was then argued as to whether or not a criminal prosecution was a bu to subsequent civil proceedings, and His Hocour Judge Skinner Tümer held that it was rot a bar. CounseTMTMTM formally submitted a certified copy of the conviction of defendant at the criminal trial, and said the only ques-- tion to be sented was the amount of damages.

Plaintiff gave evidence that prior to being injured he earned $20 a month, or S17 or $18 in bad times. He was now earning nothing.

In answer to defendant, witness stated that he owned bis own sampan. It was our of hire at $1 a mouth.

Defendant: That is ridiculous. A sumpan is more valuable than a ric- sha, but a ricsha is hired out at 50 or 70 cents a day.

Inspector Mellows produced medical certificate stating that it might be some months before plaintiff was able to carry on with his work pró- perly. Speaking on the earnings of sampan men, the Inspector mention- ed that the value of jetties from the sampan man's point of view, varied. There was plenty of business at the jetty where plains had worked. It was the custom of the Ningo men. to have a head man at each jeny. They were very clannish, and each man had to buy himself in. Witness had known a sampan man employed by the Customs give up a job worth Ts. 12 month in order to go to this jeny to work. Sempans were hired on at from 1 to $3 per month, ac-. cording to condition. The hirer, wit- ness mentioned, would have the dis- advantage of working as an outsider, the regular men at the jetty taking care that he did not get his turn too often Witness was asked by the relatives of plaintiff, to see what could be done for him, on the strength of 2 statement in Court by defendant's counsel that handsome compensation would be paid.
