The question of whether the Federal. Commissioner of Taxation has the power of imposing a tax of 13 per cent, en totalisator money paid in divi« dends was argued before Mr. Justice Knox (Chief Justice), Mr. Justice Isaacs, Mr. Justice Gavan Duffy, Mгx justice Rich and Mr. Justice Starke in the High Court at Sydney (N.S.W)) last month. It arose upon an applica- tion on behall of the Automatic Total istor Co. and Mr. Colin Stephen Chairman of the A.J.C.) for an ins junction to restrain the Commissioner from imposing the proposed impost Mr. Langer Owen, K.C., Mr. Lamb, K.C., and Mr. Weigell appeared for the applicants, and Mr. Weston repre- sented the Commissioner.

Mr. Langer Owen said the question arose as to whether the totalisator

could be deemed to be a lottery within the meaning of that term in law. Counsel quoted numerous cases to support the view thar the tute was now a lottery, and he, said it was impoé- sible for him to conceive how ir could be said that the winning of a prize on the tote was determined purely by. One went to the tote and chance. backed his choice. He put his money on the horse he thought was going to Win. The machine automatically gave hin a ticket which represented the horse upon which he had put his money. After the race was over the amounts invested in the machine were added up and the prizes mechanically given to the persons who picked the winners.

Mr. Justice Gavan Duffy remarked that if the tomlisator, was a lottery betting with a bookmaker was a lot-.
