Mr. Justice Greer, in the Commer ciel Court of the King's Bench Divi- sion. had before him an action by the Mangaldai Tea Co., Ltd., Leaden- Phall-street, London, against the Eller- man Lines Ltd. of Moorgate-street. London Plaintiffs, as the holders,of a bill of lading in respect of.<479 chests of tea shipped on board the "City of Canton." from Calcutta co London, claimed a declaration tha: the shipowners were not entitled to carry over the tea from London to Glasgow, and that they were not enitled to claim the bill of lading or any weight upon delivery of the tea at Glasgow, or to ckim or exercise any lien in respect of the freight..
Mr. R. A. Wright, R.C.. opened for the plaintiffs, whose case was that the bill of lading 'provided for the cart- age of the goods from Calcutta to London, and for delivery of the goods. to the plaintiffs at London en payment of freight at AS 10s. per ton, less. 5s. discount. The steamship arrived in. the Thames on or about January 22, 1920. but without discharging any part of the goods proceeded to Glas- gow and had there discharged the same. The defendants. by letter from their agents, dated March 1, 1920, had asserted that they were entitled to be paid freight at the b) of lading rate in respect of the carriage of the goods, and had declined to allow the plaintiffs to have delivery except upon payment of freight at the rate speci- fied in the bill of lading. The plain-. tiffs contended that in the events that had happened they were not liable for the ball of lading. or any freight, and were pntitled to have the goods de- livered to them at Glasgow without any payment of freight.
Defendants said that on Thursday, Feb. 19. 1920, several steamships. including the vessel the City of Canton, were detained at London unable to discharge their cargoes of tea owing to the congestion of the porr A meeting was held between #representatives of the Ministry of Shipping. of the Ministry of Food. and of the Ministry of Transports, re-, presentatives of the various shipown- ers-concerned, and representatives of the tea trade and of ter merchants concerted in the cargo. A BISHOP'S RIGHTS.
REFUSAL TO INSTITUTE RECTOR-
Mr. Justice Coleridge delivered judgment recently in the action by Sử J... A. R. Gure-Booth against the Bishop of Manchester for having, re- fused to institute to the living of the Sacred Trinity, Salford, the Rev. C. S. Carey, whom Sir Josslyn had, is patron, presented.
It was admitted, said the judge. that Mr. Carey habitually practised the reservation of the Sacrament, the wearing of vestments, the ceremoniat use of incerise, and the unnecessary lighting of candles "on and abour the Communion table.
The Bishop, in refusing to institute: Mr. Carey, duly informed the plain fit of his ground for doing so. The Bishop had a right to interrogate the clerk as to his practices, and, if they were illegal, to demand that they should be discontinued. On any view, three out of the Four practices cited were illegal, and, the clerk, having
refused to discontinue them, was not

His judgment, therefore, was that the Bishop was not bound to institera Mr. Carey, and that the Bishop, had s right to institute his own nomineee.
