SHIPOWNERS AND LIFE CLAIMS.

MOTION IN THE ADMIRALTY COURT.

JUDGMENT.

In the Admiralty Court, Mr. Justice Hill gave judgment on the plaintiffs summons and cross-motion by the defendants in the action of G. Maurice, owner of the French salvage vessel "Yvonne Odette" against the Oceanic Steam Navigation Company, Lid.. owners of the steamer "Cedric." The motion asked that the owners of the "Cedric" should be at liberty to pay the amount of damages found by the registrar to be due to the owners of the "Ivonne Odette" pending the ascertainment of the damages in the life claims which has been brought against the defendants, and for e de claration that the owners of the "Cedric" were entitled to recover con. tributions from the plaintiffs for half the amount of the damages and costs in the life claims.

The argument on section-1 of the Act was based on the decision in the Cairnbahn (1914, p. 25), and was that section 1 included loss to the owners of the "Cedric" by reason of having to pay damages for loss of life on board the "Yvonne Odette.” The argument on section 3 of the Act I was based on the specific words of the section, which provided that where loss of life or personal injury were suffered by any person on board

vessel owing to the fault of that person or of any other vessel or vessels, and a proportion of the damages was recovered against the owners of one of the vessels which exceeded the proportion in which she was in fault, they might recover by way of contribution the amount of the excess from the owners of vessels to the other vessel or the extent to which these vessels were respectively in fault. He was not at all sure that section 1 had any reference to liability for life claims, which were specifically dealt with by sections 2 to 4, but assuming section 1 and the reasoning in the decision of the Cairnbahn did apply to life cisims of each of the sections I and 3 was subject to a proviso. His Lordship, in giving judgment, said in the damage action between the "Yvonne Odette" and the "Cedric" both ships were pronounced to blame. The "Yvonne Odette" was lost with

The amount of damages in these actions had not yet been deter mined. The owners of the "Cedric" asked by motion that they might be at liberty to pay the amount of dam ages found by the registrar to be due to the owner of the "Yvorne Odette" into court pending the as certainment of the damages in the life claims, and asked for a de claration that the owners of the """Cedric were entitled to recover con tributions from the owner of the Yvonne Odette for half the amount of damages and costs in the life claims, and that upon ascertainment of the damages and costs in the life claims and payment thereof by the owners of the "Cedric" that they might be at liberty to deduct amount or set off against the of damages found done from them to the 'owners of the "Yvonne Odette" half the amount of the damages and costs paid in respect of the life claims. The question for decision was whe ther the owners of the "Cedrie" were entitled to such contributions. As suming that they were not in a position to prove personal negligence causing the loss on the port of any particular deceased man as an answer to the claim of his representative, the owners of the "Cedric" were responsible in full in respect of the life claims. Whether they were from contribution .entitled the owner of the Yvonne whether Odette"

depended on the Maritime Conventions Art 1911, gave them the right. Apart from the Act they could have no such right.. It wascontended that they were given the right by sections 1 and 3 of the Act.

damages for loss of life if the damages could in the first instance have been recovered from the owner of the "Yvonne Odette" had he been sued. That was carried out by sub- section 2 of section 3, which entitled the paying owner to stand in the shoes of the life claimants. In either case they had to find out whether the damages for loss of life on board the "Yvonne Odette" could have been recovered from the owner of the "Yvonne Odette," or whether he was exempted from liability by any pro- vision of law. It was assumed in argument that the liability of the owner of the "Yvonne Odette" was governed by French law, If it were governed by English law the owner of the "Yvonne Odette" would certainly be exempt from action under Lord Campbell's Act, the defence of cam mon employment would be open to him. His only Hability would be under the workmen's Compensation Acts. The "Yvonne Odette" was French, and he owner was not liable under the Workmen's Compensation Acts. He had to ascertain whether under the French law the owner of the Yvonne Odette" was exempted from liability for loss of life of the master and seamen on board his own ship. What was the French law was a question of fact. He had before him two French lawyers who expressed directly opposite views. One for the plaintiffs "said that the question was determined by articles 1 and 2 of the law of 29th December, 1905, which declared the owner free from liability except in the case of his own personal negligence. The witness for the defendant said that the law of 5th July. 1915, which was passed to give effect to the Convention, ove rided the law of December, 1905. The French law seemed to him to deal only with the incidence of liabilities as between the owners of the two ships at fault, and not to give to the persons injured, causes of action. He held that the owner of the "Yvonne Odette" was exempt from fiability to the representatives of the deceased members of the crew of of the "Yvonne Odette." He con- firmed the registrar's report, with costs, and dismissed the defendant's motion, with costs.
