The closing stage in the Lusitania dicase at the Liverpool Assires, JBG- reached when, by verdict of aspecial jury, the Cunard Steamship Compare ngessfully, restated a claim for damages-under the Fatal Accidents Act by Kate Capablic, in respect of their servants, alleged negligence in Ecossection-with the deathyak ber Chusband, John Coughlin. It appearedh that the latter, an Iziph-omigrant, bad been working for some years as aminer in Bute, Montana, sad #39, on his way in company with his wife and three children, to settle down to a farming life in Ireland, when the Lusitania was torpedoed and he and one of their three children were drowned.
The alleged negligence consisted of disobedience by. Captain Turner, who was in command of the Losk tania" at the time, be Admiralty instructions to give. headlands a wide berth in submarine-infested waters, to adopt the process known as zig-zagging, and to spprasch ports. at top speed and in darkness, if possible; also in the region where the "Lusitania' was sunk to steer
a mid-channel course..
Addressing the jury on behalf of the defendants, Mr. Rigby Swift, K.C., who, along with Mr. W. A Raeburn, K. and Mr. A. Hyslop Maxwell, has been.briefed by Mesars. Hill, Dickinson and Co., said it was easy enough to say to Captain Turner that if he had been a few miles further south off the Irish coast than he was at the time of the disaster he would he had been all right. But would" he? They had to remember where the torpedo came from. It came from the starboard-it came from the seaward side, and was fired by a submarice which was further south than the "Lusitania," and how far the submarine had been coming up as the "Lusitania" approached, in order to meet the "Lusitania, they. did not know.
With regard to the speed at which“. the "Lusitania" was travelling,; the difference between 18 knots and 21 knots three knots was spoken 9 as thought it were going to make the vessel go through the water like a flash of lightning, so that no sub- marine could even ste her, let alone

Despite everything to the contrary the jury were asked to say that the voyage under notice met with its ́al- fated end though-the negligence of Captain Turner in being where he was at that particular time, in not proceeding at a greater speed than 18 knots, in not zig-zagging, and in not being in the danger zone in the dark. He invited the jury to examine all these matters as business menz dealing with a business proposition. to be guided by the evidence which had been given in the case. He also most respectfully urged upon them with all the force of which he was capable that approaching the case in! this way, they should come to the conclusion that the plaintiff, upon whom rested the burden to satisfy them, not as a matter of guess or speculation, but as a matter of evidence: upon which, as business. men, they could rely, bad failed in her duty, and that there should cont sequently be a verdict for the defendants.
SERJENT SULLIVAN'S REPLY. Serjent Sullivan, K.C., who, with Mr. Thos. Scanlan had beep retained for the plaintiff by Mr. Herbert Z. Deane, in the course of a detailed criticism of the evidence for the des fendants, said it was perfectly clear that John Coughlin had never read the terms and conditions upon his passage ticket. He was not educated to a sufficient extent that he would read the document for amusement, and the company admitted that they had not taken any steps. beyond, hay- ing put the document in Coughlin's
