I allowed to proceed to Rozlerdara carry-- ing in her hokis the four parcels of goods other than the phosphates which wete not consigned to the N.O.T. I was stated that with regard to the phosphates and the other four parcels of goods, there was good cause for action on the part of this Government that disposed of there being any ques-- tion of wrongful seizure or wrongfu detention, but it was said the Govern ment ought to have acted with a de- gree of despatch with which they did nomach- -When his Lordship found the master of the vessel was notified by June 12, almost immediately on his arrival, and before he could have discharged his London cargo, that ha could not proceed to Rotterdam with these several parcels on board, and' in the condition in which they were, it seemed to his Lordship a very strong, argument against the case of the claimant at once arose. I WAS suggested that there should have,been. some final notice of seizure, and that' in the affidavit which one of the Cus- toms officers had made, it appeared that the first order to detain the four parcels was made on July 5. IF nothing had happened on the part of the Creen bereen June 9 and July,“ S the question: would have had to he considered, but what his Lordship found to be quite clear was that the master was notifed by June: 12 that he could not proceed, and would not get his clearance as long as these goods, with which the Crown WAS E- titled to deal, and with which the off- cers of the Government were bound to deal, were in his bold, and no pro- visions were made to prevent their transit into Germany.
In that state of the case what hap
pened? The master and the claim ant's agents--their agent in London
and their New York office-set to work to do the best they could to get round the difficulty, which arose by reason of the Proclamation of March" 11, 1915. They used diplomatic: pressure, but it did not succeed, and they conceived the method of taking the goods to Rotterdam and bringing them back, bar that did not succeed., They negotiated for all they knew how with the representative of the N:O.T. A prominent representative of that Trust was in London at the time, and gave them every facility and was ready, not to become consignee of these goods in place of the apparent consignees unconditionally, but to become consignes of the goods if the corporation were able to give propert security that the vessel herseit should not be taken an from Rotterdam into- Germany. It was significant in this. case that the N.O.T. would not take any action on behat of the consignees of the goods. It was not material to the question at issue, but it was signi- ficant with regard to the good judg ment and discernment of the officers of the Crown who were dealing with the goods. The real reason why there. was delay berweer. June 19 and the beginning of July in the clearance of the ship, was that her master and agent the representatives of the ten- porary, owners were doing their best

They had ait authorised capital of 5,000 dollars for carrying on the Transatlantic trade be-- tween American ports and Holland in time of war, and they could not get By underwriters. It would have been amazing if they could, unless there was a firm of philanthropists of capital of some. Continental bank be--- hing them, and, not getting under- writers, they were not able to take the course they were desirous to take, “ There was no disposition, when they found themselves under restraint på- princes, to relieve themselves by put ring these goods on the quey. It was a comparatively simple course, but it would not have suited their pur pose, because they would have disap peared from the carrying trade of the Atlantic almost as soon as they had begun. The fact was this enterprise found itself confronted with serious difficulties which arose out of the state of war. It had gone into liquidation, and if now made a claim against the British Government for compensation. for that interference with trade which in fact was unavoidable under the war. When the clain came into the court: to be examined it seemed to his Lord- ship to be a hopeless case. The post- tion of the claimants was that in which they were placed by the force of cir- cumstances. The. Government notified them quite early that they could not proceed under the conditions under which they wished to proceed. They neither landed the goods nor carried out sny of the conditions. Their loss was their own misfortime, and it it had resulted in the disappearance from the list of competitors for the Atlantic trade of this company with a capital of 5,000 dollars, it was a misforture that must be laid at the door of those
