Ritter and Wife v. Godfrey-Judg. ment was delivered in this case in which plaintiffs, Mr. Fred Ritter, barrister-at-law, and his wife, sued Dr. T. H. Godfrey, The Orchard, Longlane, Finchley, för alleged negli- gence at the birth of a child which was stillborn. The allegations were denied by defendant.

Mr. J. B. Matthews, K.C., and Mr. Herbert Jacobs (instructed by Messrs, H. Dade and Co.).appeared for plaintiffs; and Mr. Rigby Swift, K.C. Mr. Neilson, K.C., and Mr. Waldo Briggs (instructed by Messrs. Young, Jackson, Beard, and King) were for defendant.

His lordship Mr. Justice McCardie said there was no doubt about the

law, for it had been held again and again that every man who entered the medical profession undertook to bring to it a reasonable degree of care and skill, and he was bound to show not only competentskill, but also sufficient attention. There was no obligation on him, in his lordship's view to possess or to exert the unusual and highly-trained skill of an extremely- trained specialist, nor was he necess arily bound to know or exert the most recent manipulative devices in- vented in hospitals yesterday or to- day. He was bound only to exert reasonable care and skill. The skill and competence of the defendant were fully admitted by plaintiffs. Defendant's experience ranged over some 1,500 cases of midwifery.

diagnosis which defendant made was erroneous, but it had been pointed out and be accepted it, that it was quite possible for, the most skilful man to make a mistake in a diag- nosis of that sort. The circumstances. in his lordship's view, supported the opinion which defendant had formed. The professional skill of defendant had not been challenged in the 3th August at 1p.that his lordship could not hold that slightest measure. It was admitted 8th August at I p. a man was guilty of negligence 12th August at 1 pm because he abstained from using a

method, which he found, to be inap propriate to his own physical attri- butes, and to be unnecessary in view of his wide prior experience in cases of that description.

In his lordship's view, plaintiffs had failed to show that the death of the child was due to the negligence of the defendant. He was wholly satisfied that the action was brought by Mt. Ritter with a deep belief that the defendant had been negligent. He desired to say further that he deplored the letter which the defend ant had sent to Mr. Ritter. It was a re grettable letter, wholly lacking in real sympathy for what was a deep sorrow to. Mr. and Mrs. Ritter. He could well understand the statement by Mr. Ritter in the witness-box that one of the reasons which led him to bring the action was the unhappy wager, as Mr. Ritter called it, which was preferred by the defendant in con- nection with the matter. That letter was written within ten days of the death of the child. It was written to a man who was suffering deeply from the loss of the child. Defendant' said this:

That was a letter, written by a member of the great medical profes sion. His lordship deeply regretted to say that the letter was very incon-- sistent with the high dignity that should ever be preserved by members of a high profession. He gave Judg ment for the defendant on the claim and counter-claim, the latter being far fees of twelve guineas, and sug- gested that the defendant's legal advisers should be consulted as to whether they desired to claim the costs.
