Lord Sterndale and Mr. Justice Hill, sitting as an Admiralty Divis sional Court, recently heard the appeal of the Vancouver Steamships Co., Ltd, as owners of the steamship "Vancouver from the judgment of Judge B. Fosett Lock, delivered in the Hull County Court in May. 1918, in an action brought against thera by the Olympia Oil and Cake Co., Ltd." and E. D. Sassoon and Co... for short delivery at Hull by 159 bags of a cargo of cotton seed.

Mr. Leck, K.C., for the appellants, said the judge gave judgment against the shipowners for the value of the cargo shortage. The shipment; according the bill blading, was 4,872 bags, and the question was, did not the judge give undue weight to the bills of lading, as being prima facie evidence against the shipownera, and whether the burden on the ship- | owner had been discharged by the evidence that was called. The Olympia. Oil and Cake Co. were the holders of the bill of lading, and E D. Sassoon and Co. shippers on the Vancouver" at Bombay on Decent- ber 30, 1915, for carriage to Hull.

Lord Stertidale, giving judgment said that evidence given was that this cotton seed was first talked in the warehouse at Bombay as destined for shipment. It was then tallied. out of the warehouse by a clerk of the Port Authority and a clerk for the ship's stevedore. Apparently they sometimes tallied at different places, one at the warehouse door and the other on deck, but this time- they both tallied at the warehouse door. by coolies from different doors, and i was said they sometimes crossed those from the door on the left, and those from the door on the right and the suggestion was made that as they crossed they might get the goods on the wrong ships. The master said he signed the bill of lading after checking the tally sheet with the number of bags on the bill of lading. His lordship did not see anything to prevent that bill of lading being prima facie evidence of the number of bags. Whether it was prima facie evidence of their being cotton seed he did not know, but there was other evidence that the bags delivered contained cotton sent. Nobody tallied on the ship's side or on deck. He should say there was prima facie evidence that the bags taken out of the ship were the bags shipped on the ship, and as the bags taken out contained cotton seed, he should say the specified number of bags was put in the ship. The chief complaint of the judge's finding was that he said the bills of lading were prima facie evidence of the shipment of the goods. At any rate, there was other evidence besides. It was said there was no prima facie evidence of the weight, but he bought the des fendants were precluded from taking that point by the admissions they had made No empty bags were tendered, and they had said, "If we delivered, 195 bags short we are Hiable for £138," He thought Hthat precluded any question whether the exact weight was as specified in the bill of lading. The claim was not upon the bill of lading weight at all. The claim was on the outturn of 4,717 bags working out at a shortage of 159. There was evidence that no cargo could have been put that the ship was duly emptied, and

out on the voyage. If they did not accept the defendants' evidence that these goods were not shipped, it was true that it was difficult to say where- they were. The judge suggested various ways that they might have been received and got rid of. It was quite easy to criticise these sugges tions, but the main thing was that the judge was not satisfied that the defendants had proved that these 800ds were not shipped. If there against the ship that the bags were was prima facie evidence raised

shipped, as the Divisional Court thought there was there was the prima facie evidence of the bills of lading and other evidence the onus was upon the shipowners of proving that they were not shipped. They had not discharged that onus, and he saw no reason for interfering with the decision, of the learned judge below. The judgment of his honour Judge Lock must be up- held and the appeal dismissed.
