Three peers who are large owners of mining royalties-Lord Durham, Lord Dynevor, and Lord Dunraven--- were called to the bar of the Coal Commission in the House of Lords on May 7. They did not come will. ingly, having been subprenaed at the instance of the miners representa- tives chiefly to show by what title they claimed to possess royalties at all

The evidence of the peers on this point gave some interesting glimpses into the history of ancient families, such as Lord Dynevor's story of how Henry VII. beheaded his ancestor Rice Griffith, and nationalised bla Carmarthenshire estate by that rough- and-ready method. The chief interest of the occasion was the mere fact. that these privileged persons were for the first time called upon in per- son to defend their position.

Lord Durham, who owns the coal. under. 12,411 acres in that county and drew over £40,000 in royalties and wayleaves last year, was the first titled owner to be called. Lord Dur- ham did not bring his title deeds in a railway van as the populace had been led to "expect. He stoutly based himself upon immemorial law and right. In this he appeared to have the silent sympathy of the employers' side of the Commission. The big

Mr. Smillie was courteous but firm in pressing for answers and resisted points. In his evidence Lord Durham any temptation to make rhetorical

had stated his case as a private owner, against nationalisation with great candour and in much detail. Mr. Cooper, and of the mineowners, rushed to his rescue when Mr. Smilie tried to get him to admit, by means of quotations from legal luminaries and the Bible, that there is no absolute ownership of land, but Mr. Cooper was brushed aside. Lord Durham shortly declared that he was not a constitutional lawyer, and as to the Bible, he retorted with another quotation "Render unto Cresar the things which are Caesar's." "My family," he said, "have owned land for a great many years and no- one has disputed our right." "But we desire to do so now," said Mr. Smillie quietly.

A little later there was the follow- ing dialogue !

Mr. Smillie: You may be a per fectly decent landowner

Lord Durham: Oh, thank you (bowing).

Mr. Smille: You may be. That is what we have to find out.

Mr. Smillie, tried without success to get Lord Durham to admit the unsatisfactory condition of miners cottages his county, and finally asked the witness whether he would like to live in a miner's cottage. Unlike Lord Durham, the next witness, Lord Dynevor, was cool and collected and ready with a non- committal reply to anything that Mr. Hodges, the clever young secretary of the Miners's Federation, could ask him. He even scored a point for his side in pointing to the unwillingness of the State to work directly the collieries in the Forest of Dean."

Lord Dunraven could throw no light at all on the miners' accusation that a colliery on his estate in Wales had to close down because the royalties were actually more than the profits, an event which is said to - have thrown 300 men out of employ ment. Lord Dunraven's

agent, when called in, to assist, could not throw any light either, and he did not seriously deny Mr. Smillie's thrust that his only concern as an agent was to collect the royalties. -The rest of the day's evidence
