"Mr. Valpy then proceeded: In the 1916 ledger account $87,137.01 was. shown so credited: in 1917 $10,638 aad in 1018 $28,75513. This was up to the and of September, 1018, when Mr. Benjamin went exay. The petitioner agreed, and ako ad- mitted that the amounts credited for: three years was $87,591.09 and that the amount shown by Bim as derived from brokerage and profits on shares in those three years was $138,870.17. The petitioner advirted that, the Famount credit to Mír. Benjamin ön share account was $95,501.09, which therefore should have represented a bo Rage of $171,062.18 That ex- jeevdal the pofits which we had work- jed out by $34,629.01. That did not show his account was incorrect. Mr. Benjamin went in for jobbing as well asking on the firm's account and somethings, perhaps frequently, the Grm made a profit. Sometimes on the other hand they made a loss. When there was a profit Mr. Ben- jantinh got half. When there was a lows he nee nothing good. In fact he ankled profits to the brokerage and took half on both. He also charged brokenge.on shares which were never delivered. Coming to the profits and losses petitioner said in reply to Mr. Valpy, that for three years 1916, 1017 and 1018 the nett profite from sipping were $890,000, from shares $33,800, from bis cat landed pro- perty $30,000, and from exchange business $30,000 (the whole amcant for the three years being $872,800. Petitioner also admitted, in awer to Mr. Valpy, that for the same period his drawings totalled $128,000, those of Mr. Benjamin $85,000, of his son, C. Latham, $7,000, rent $7,000, salaries of stuff $15,000, salary of Mr. Ort $10,000; loss, os Bangkok mine $9,000, Bangkok office' 86,000, Kuala Lumpur office $1,000, and a prospecting $1,600, making a total of $291,000.

Mr. Valpy: This leaves a surplus

of $81,800. How do you account for that?

The Petitioner: I cannot under. stand it at all.

His Lordship: What is it you do not understand?

Mr. Valpy (to petitioner): I am asking you for an explanation and the Judge is waiting for it.

The petitioner who was asked several times to explain, only replied **I cannot.**
