Mr. Master, in prosecuting, said that at the last hearing the facts. for the prosecution had been proved and the case had been adjourned pending an appeal on the question of whether the importation of opium into China by a British subject was an offence. Mr. Priestwood, for defendant, said it was understood at the con- clusion of the last hearing that the defendant pleaded guilty on the facts, and now counsel had been instructed to express the defendant's

sorrow and regret for what he had

done. Defendant had been with the British India line for 22 years, during the last seven of which he had been a chief engineer. Defendant had returned to Shanghai as soon as he had been able and Counsel submitted that in this case a fins would meet the offence. Counsel also urged upon the Court the fact that when the sampan in which the defendant was going ashore was stopped and the police officer fall into the water, the defen dant, if he had been a criminally minded man, could have disposed of the opium and made his escape, instead of which he waited to rescue the oficer and the Chinese who fell in endeavouring to get him out.

Capt. Walker, of the P. & O.. Dilvera, said he bad known the defendant since 1904. He had an excellent character and witness. could only speak of him in the highest

terms.

Mr. Master said he had no ob jection whatever to the application for leniency. His clients were aware of the fact of what took place when the police officer fell into the water and considered that the defendant

assisted materially in saving the officer's life.

Sergt, Chegwiddin, the officer in question, said that the defendant could have escaped if he had wanted to when witness fell into the water.

The magistrate, addressing the defendant. said he could not under- stand a man of the defendant's char- acter and the service behind him, helping what China herself and what Great Britain had been helping China to put down, namely, opium smok ing. The case had been treated by the Court summarily, his powers were limited and he had been asked specially not to send him

Prisoner had been on a visit to his sister at Lancaster on sick leave, having been wounded in the head and stomach. He returned to hos- pital at Colchester on December 10. He also visited relatives. at Darling ton and West Hartlepool, and he dis pesed of or left jewellery at those places, a packet of jewellery being subsequently found under a bed he had occupied.

He also sent valuable presents. of jewellery to his sister, and gave rings: to nurses at Colchester Hospital and other people in the town. He was arrested in London in February on another charge, and he bad then

about £200 worth of jewellery in his

possession.

This led to his arrest on the shop- breaking charge, and be at occe offered to belp the police to recover as much property as possible, a promise he kept. He said he could not have been in his right mind when he did it.

Altogether about £390 worth of jewellery was recovered. Prisoner told the magistrates he had never been the same since he was wounded in the head, and he expressed his deep regret for what had happened.

According to prisoner's own state- ment to the police he has led a most adventurous and roaming life. He was born at West Hartlepool, where he lived until he was 14 years of age. Since then he had been all over the world. He

Guiana.

Worked on the Panama Canal. Fought under President Castro

as a rebel.

Was in the Boxer riots in China,

Was in Jamaica at the time of the great earthquake in 1907.

WORKED IN SIBERIA.

He worked on the Trans-Siberian Railway, assisted to quell the Sinn Fein rising in Ireland, and in the late war was in the Alsace-Lorraine operations, and was severely wounded.
