In the House of Commons, Mr. Bottomley asked the First Lord of the Admiralty upon what principle his Department' declined to publish the proceedings at the inquiry into the loss of the Hampshire.

Dr. Macnamara.-The considera. tions which have influenced the Ad- miralty in refusing, as they always have done, to publish reports of Courts of Inquiry, are as follow: A Court of Inquiry is not a legal body, but is simply a means of en abling a Senior Officer to arrive at a correct conclusion on дау matter upon which he requires to be thoroughly informed, or upon which there may be a question whe- ther it should form the subject of a Court Martial. It cannot examine Con oath, nor compel the attendance of witnesses other than those belong. ing to the Naval Services. There is no prosecutor, nor is any person concerned in the inquiry allowed the assistance of a "friend" or profes sional adviser. Its procedure is not regulated by strict rules of law. It cannot give a verdict or award a punishment, but can merely express an opinion or make recommendations- to assist the Senior Officer (or the Admiralty) in arriving at a right conclusion or any matter. in indicating what quality of evidence is likely to be available in a case should judicial proceedings be in stituted. It must, however, not be treated as if it were itself a judicial inquiry. My hon. friend again will realise that the chief value of Courts of Inquiry consists in the fact that they e not restricted by the ordi nary rules of law and procedure, but this freedom can only be maintained by insisting on the almost informal character of these proceedings as aids to the authorities in making up their mind and by denying to the find- ings of their such courts any intrinsic validity of their own. In these circums- tances, if it were decided to publish the findings of such courts the Admi- ralty would be bound in justice to the public and to individuals to change the whole scope and character of Courts of Inquiry and make them into judicial bodies, thus destroying much of their usefulness.

WARSHIP CONTRACTS ON THE CLYDE.

Mr. Neil Maclean asked the Secre tary to the Admiralty, whether instructions have been issued to suspend work upon a number of destroyers at present in course of construction in shipyards on the Clyde, aud if he will state whether this suspension is only temporary, and when orders will be issued to complete those vessels?

Dr. Macnamara.-The work on certain destroyers building on the Clyde has beer suspended, and it is hoped that it will be found possible cancel these vessels without undue dislocation of work in hand by the shipbuilders concerned.

Dr. Herbert Eulenberg, the welf known German writer and dramatist, and one of the signatories of the well-known declaration by intellect. uals in defence of the German cause at the beginning of the war, has announced that the fuller information now available induces him to take a different position from that taken up in that famous document. In an article contributed to she Frankfurter Zeitung he refers to the contrast bet- ween the Gerimany of Potsdam and the Germany of Weimar. Potsdam, he says. bas now been overcome and the Ger.... mans mustturn to Welmar, to the spirit of Goethe to peacefulness and recon- ciliation. Unfortunately, he adds, the leaders of art and science in Ger- many are still full of hatred and bit. terness. Among learned men there are still very few who have accepted the new orientation of the German State. "Make the experiment in any crowd of people of calling for a cheer for the German Republic, and you will find how few of the in- tellectuals join. But perhaps we can. not expect a change of spirit in a night." Dr. Eulenberg says that they have all to admit their mistakes. Even Karl Liebknecht accepted in August 1914 the "fable, that Ger- many was surrounded on all sides by greedy and powerful enemies." He himself had signed the proclamat- ion of the intellectuals in completely good faith." "We must now admit that it was clumsy from the political point of view, and not at ali true, if deeply probed. But it was well meant and not really very bloodthirsty," Dr. Eulenberg pleads that the learned men were too much under the domination of Prussia to resist, and that, after all, they were. less guilty than the false prophets of military success. In any case, what they have to remember now is that they are all German republicans "They. must throw off the rough habits of the students' club and the guard-room and build up a new Germany on the model of the old civilisation of Weimar."..
