Mr. Matthews: Would you call this film a newspaper?--It is not a paper, but it is a news medium.
Mr. James O'Donovan, Parliament ary sub-editor of the Daily News, also described the plaintiff's work as editorial..
Mr. Matthews: The essence of the status of an editor is independence and responsibility, is it not? Yes, with the small qualification that no man is utterly independent when there is an employer.
His Lordship: It is so all the world over-the man who pays the piper is entitled to call the tune..
Mr. Matthewa (to witness): An editor does not always see eye to eye with his employer ? No. I have been in that position, and walked out at the front door. (Laughter:)"
Mr. Frank Smith gave evidence for the defence to the effect that plaintiff was not engaged as an editor, but was in a subordinate position.
His Lordship, in giving judgment, said he had had no evidence to show that a gentleman who performed duties with reference to a film which, were analogous to these: performed. by the editor of a newspaper. was entitled to the same notice as an editor of a newspaper. On Sept. |6, 1916, plaintiff received a letter from defendants. which stated that his ́engagement would be on the same basis as the other departmental managers, viz., subject to a month's.. notice on either side. It was said that his duties were afterwards altered, that he became editor of the film, and that automatically put an end to the notice. It was for plaintiff to stipulate for an alteration in the notice. He, however, con- tinued, subject to the terms of the letter.
In his lordship's opinion the claim failed because plaintiff was employed upon terms that he was subject to a month's notice, and because there was no evidence that a gentleman in his position was entitled to the same sort of notice as an editor of a neWS paper. Failing that, it seemed to his lordship that a month's, notice was a reasonable notice to give. Plaintiff's case failed, and there would be judgment for defendants," with costs.
