At the Magistracy yesterday before Bir. Melbourne, a machinist from the Austrian cruiser Kaiser Franz Joseph I was charged with being a deserter from the ship in this Colony.

Mr. Shenton defended. Dr. Von Weiser, the Austrian Consul, who was present in Court, cited Article 4 of the treaty of 1888 which provided that Consuls should receive from the local authorities such assistance As could be given by law for the recovery

of deserters from the vessels of the respec- tire countries.-

Mr. Belbourne said he had looked up

the point and he thought he had no juris diction. The Superintendent of Police

could only detain the man for a certain

time.
