THE EVIDENCE.
Tho frab witness was Captain A. J.
·Coloman, acting Deputy Mostof Alten- dant, who showed the court the positious of the Oscar II. and the Hong Moh on the day of the collision.
Captain A. B. Chamberlain was then called. · He stated that he had bean in command of the Seamew since May last.,, At 3 a.m. on September 1, ho left Singa pare for the usual relief trip to Horsburgh Light. On the return voyage be was on the bridge till o'clock when he handed over charge to the chief officer. At 9.40 witness went to his bunk and fell asleep partly undressed. He could" nob tell the sxact minute when he was called, but when he went np above he saw that his vossel was then B cables' lengths of the Waterwitch. Ho, was called up by the chief officer, but lie, was not award' of having been callod by the tindal. If the latter did call him he did not-wake him. When he got on the bridge they had passed the Oscar II.
Mr. Elliot: In your letter to the Master Attendant on September 5 you say you were two cables' lengths from the Water- witch.
Mr. Everitt: It does not actually read that he took charge there..
Mr. Elliot (reading) ; "* I was awaken. od at 10.54 and went on the bridge and took charge. The vessel had the B.. Zweena a little forward of my port beam; the Waterwitch right ahead about, two Jables."
Witness: That is my mistake; I should have said the Zweens was twe cables off, when I went slow.
Continuing, witness said that whon be went on the bridge there was no ship wo cables from his vessel. The Zweena was six cables off when he took charge. The Scamew was then going ten knots and be toid the helmsman," Steady s you go." The vessel was beading straight for the Waterwitch, witness in- ending to take up an anchorage outside her and half a cable's length from her. His first order after going on to the
