"AN'APPEAL. DISALLOWED.

The

Lord Chancellor, and Lord, Macnaughton, Atkinson and Robson, sitting. as a Judicial Committee of the Privy Council, have declined to grans leave to appeal in the case of Birch e. the King -Emperor, which aroused so much interest in Burnish a year ago.

The case was a petition for special leave to appeal from a verdict and sentences pronounced by the Chief Court of Jower Burmah on April 2, 1910, the first peti- tioner, Birch, having, at the time when the events occurred oat of which, the charges arose, been the acting superinten- dent of the Rhoddah Hunting) Department under the Government of Burinah, tho second petitioner, Gupta, the acting an sistant superintendent, and the

third potitioner, Mukorjee, the head clerk of the department.

"It was stated that the operations of the Kheddah Department involved the catching of a very large number of wild elephants, which were sold by the Government, and was a very profitable undertaking. For the purpose of the work a large number of hunters had to be engaged in Tadin. It was alleged that in 1907 ocrtain" of the huutocs were paid by Birch less than the authorised rate of pay.. and that he appropriated the difference, and a charge was perferred against him in the „prut pene" of "esiminal broach" of træst in regard to that alleged minappropriation of the difference, second charge being also made ng inst him in rugged to the cotry

All the palitioners denied the accusation, and a number of the hunters in their avičenco stated that they were paid at the higher rate.. The trial took place at Bangoon, and Jasted from Jan. 6 to April 2 last, the jury bringing in a verdict of guilty. Petitioners nowsked for special leave to appual against the verdict and sentences passed.
