Prisoner's affidavit,mes to the affect that on June 10th, 1909, he was arrested on charges of having committed the crimes of armed robbery and murder in Chias. Ho was brought before the Magistrate (Mr J. R. Wood) and remanded from week to work until July 9th, pending, as he believed, the arrival of witnesses for the prosecution On July 9th he was again brought befote the Magistrate for the purposes of identifi- cation. Of the two witnesses called for the prosecution one failed to identify him and the other was doubtful as to the identify. Later he was informed through his solicitor that it was proposed to discharge him on the murder charge.
