A QUESTION OF COSTS.

Mr Davidson objected at the Suprame Court, this morning, before Mr Justice Gompertz, to Me Jackson, of Messra John- ston Stokes and Master, setting out defence by pisadings in a case which was mentioned, as he had understood that Jackson, was only going to put in a contar claim. Ho, had not had the leave of the court to file pleadings and Mr. Davidson thought he ought not to be charged with their cost, in the event of the action being decided, against his client

Mr Jackson-I am not going to charge my friend with the cost of setting them out As a matter of fact they were copied straight from Bullen and Losk. (Laughter.)

At a later stage. Mr Davidson said that Mr Jackson now told him that he would not charge him with counsel's feos for setting out the pleadings but that he was going to charge him with setting the plund ings out himself. He had filed those ploadings without the consent of the court. Mr Jackson--I got leave to serve a de- fence. It is nct the time now to argue the question of coals,

Mr Davidson-I mention it because the facta are fresh in your Lordship's mind and if it is mentioned later there might be a difficulty. He never got leave for those pleadings.

Mr Jackson-I got liberty from your

lordship. If my friend did not know what I was asking for he should have ankel mo for an explanation.

His Tordship might have to decide that question.

Mr Jackson-It is suficient to mention it to your lordship...

The matter then dropped.
