Mr G. Smit, sighted a floating mine. The steamer was heaved about and the mine fired at by a 3.7 cm.-gun and rifles, but the skip could scarcely be kept in a favourable position. About 30 shots were fired with the gun and 290 with the rifles, but Although several hit the mine they failed to explode it. It appeared, however, stopped further efforts, The mine was to be in a sinking condition, when darkness about a foot above the waterline when first eighted, but when last seen showed only a few inches.

THE REPRIEVE OF A CON-

DEMNED LAWYER.

Famous New York Cage. ALBANY, JaD. 15.-Albert T. Patrick, the New York lawyer, convicted and awalt- ing execution in Sing Sing Prison next week for the murder of Williams Marsh Rice in New York city in September 1900, was reprloved this afternoon by Governer Higging until March 19th, a space of fifty- six days.

The reprieve is granted for the purpose

Patrick's before a trial court alloged newly-discovered evidence. Its granting followed a hearing before the Governor in accordance with a request of former Senator David B. Hill and Judge William K. Olcott of counsel for Patrick, and with the full consent of District Attorney Jerome, who was pro-

sent.

The Patrick caso is one of the most remarkable in the criminal annals of the country. Arrested on October 14, 1900, for having chloroformed William M. Rico, a millionaire reclase, to death after his aged client had made a will in his favour, Patrick succeeded in postponing the deci. Bion of his fate for over four years. Every possible legal point was taken advantage of to defer the execution of the sentence of death imposed on April 7, 1902, and the case attracted attention throughout the country.

In June last when the Court of Appeals sustained the judgment of the trial Court, it was believed that Patrick's fight had been in vain; but even then his attorneye did not despair, and as a last resort the Governor was asked to stay the execu tioner's hand on the ground that the de- lence had discovered new evidence tending to show that Rico died of natural causes and that no crime had been committed. On this showing the roprieve was granted, and there is a probability that Patrick, in the event of securing a new trial, may yet be acquitted,
