An Action was recently brought before the Outer House of the Court of Session by the Tyne Improvement Commissioners againata Danish Company which owned the 6.9. Kund. Judgment
on the 3 for payment of £4,489, -
delivered by Lord Johnston h-August. In November, 1909,
the Kund" collided with another steamer and became a wreck within the limits of the port of Newcastle-on-Tyne, The Commissioners lighted and buoyed the wreck, broke the vessel up, and removed her. The defendants tendered the sum of £4,000 in April this year, and afterwards increased their tender to £2,500, in esch case with expenses to date. Lord d Johnston found against defendants for £2,146 with interest at 5 per cent, from the date of citation until payment, holding plaintiffs entitled to expenses down to 97th June this year, and defendants to expenses there- after. He thought that in rejecting con- tesot work and in undertaking the operation themselves the plaintiffs committed af error of judgment which disentitled them to recover on the basis of their actual
tionally, but practically, extravagant. In the matter of watching, etc., they paid a, tug by the hour, and did not take tenders for the service. He thought the price paid to the tug-owners excessive. He reduced the plaintiffs' claim to £2,146 196. 94,, less proceeds of sale of salvage, for which he gave decree.

A Tokio despatch in Lokohama paper saya-Capital has been obtained among financiers here for a steamship service be tween Manils and Japan. The promoters
of
the company are business men resident in Manila, who were led to make applica- tion to Japanese capitalists because they believed that the raising of the needed money for establishing the line cou'd not he effected in American sources. Among the promotor is Raphael de Castro Midal- go, Chairman of the Manila Chamber of Commerce. Midalgo has been prominent in the anti-American crusade in the Philip- pines
and after the massacre of Captain five years ago, was arrested and charged with Farley and his men in the interior, about
running guns to the natives. Inda nce was brought to bear at Washington and Presi dent McKinley pardoned him on his promise to stop supplying the natives with gund, Midalgo recently sailed from America for England, where he is to purchase air steamships having a

The owners were bound to supply the captain with funds, but they did not do this, and the men had never been paid any Wagos at all. It appeared that on May 18 The captain saw them, and told them the owners had not sent any money. On the 18th the captain was takon ill-it was a very unhealthy place and he died next day. Even this did not occasion the owers any anxiety, for they sont, no money, even though these inen were with Gut money, and were in fact penniless. Three Nights on a Raft;
On the arrival at Plymouth on September 9 of the Orient Pacific Uner
or "Omrah," en route to London, a thrilling story of the sen was related.
It appears that on the morning of Sep. tember 6 last, soon after passing Capo St. Vincent, the third officer, Mr A, H. Frasor, who was on the bridge, detected something unusual away on the port beam of the mail steamer. What "it was could not be at once determined, but Mr Fraser continued to examine the object floating on the sur face of the water away on the seaward side of the "Omrah," and speedily other telo
scopes wore trained in the same direction.

to
Later fuller views of this object were ob tained, as from time to time the wreckage, for so it now appeared to be, rose on the top of a huge wave, only to be lost sight of the next moment in the trough of the seas, which then were running very high. The weather indeed was most boisterous at this time, and the wind was rapidly hard. ening to a gale. Once convinced, how. ever, that there was wreckage near, the course of the "Omrah " was altered so as permit of the object being closely examined, with a view to discovering whether thero was anyone on it in need of assistance.
liner drew nearer, Mr At the
great Fraser made out the form of a buman being lying across what was really an improvised raft, constructed of just a couple of planks. Then, almost before the throbbing engines had eased, and while the "Omrah etill slowly moving forwards, the hitobat was rushed into the water, and pulled off under the direction of Mr Fraser.
བ
In a very short space of time the boat got alongside the raft, and there, without food and water, they found a Spanish sailor lad in a state of collapse and unconscious. The. crew hauled him into the boat, sent adrift the little raft, and then started to pull book to the steamer. The "Omrah" had been manoeuvred by her commander, Lieutenant W. S. Shelford, R.N.R., so as to afford the rescuers as much shelter as possible, and, amid the cheers from the passengers and ship's company, the boat safely reached the steauer's side, and soon all were on deck, The castaway was at once handed over to the care of the ship's surgeon, Dr Lucas, and ho gradually recovered, and later was able to relate tragio details of a disaster in which he had had a
was Juan Delgardo His name, ho are Lamtano, and he was one of a crew of soven belonging to the Spanish brigantine "Carmen," on which he sailed from a port in southern Spain for Setubal, Portugal, on September 8. Tho Carmen encountered squally weather, and at one o'clock the following morning she suddenly. capsized, without the slightest warning, all her crow being thrown into the water.
between Juan Lamtano, who is only eighteen and nineteen years of age, managed, however, to grasp a couple of floating plants, on which he found two other of his fellow-seamon. The two planks were lashed together, and for, a time served to keep the trio afloat. When daylight came, the horror of the situation presented itself more fully to the minds of the sailors, They wore afloat on a waste of waters with a storm rising, and without sail in sight. Of food or water there was none, but just before the catastrophe the crew had all been served with hot coffee. Then night came on and in those hours of darkness Lamtano lost his two companions, both being swept away be the seas. Over- come by exposure the lad drifted on the raft for three nights and two days, and during that time only two vessels camo within hailing distance of him, but so weak and feeble was he that he could do nothing to attract their attention. In fact, he gradually fell into a sort of stupor, from which he was roused only to find himself on the "Omrab," which conveyed him to London.

"RALEIGH". BONOKONO. On Saturday afternoon, at the Polo ground, the baseball team from the U. 8. Raleigh" defeated the Hongkong base ball club by 25 to 11. Although rather one- sided, the game was interesting and was marked by very heavy batting, the fielders having plenty of leather chasing to do. It would seem that baseball is becoming popular in Hongkong, there being a large number of spectatore, many of whom were English soldiers, who evidently wish to be- come more familiar with the national game of their American cousins. Many remarks were made as to the similarity of baseball with rounders, from which game it probably originated. PEKING, October 9. Russians are operating iron mines in the New Dominion, at Kashgar, Urga, and Ili, and are also interested in several gold, sil- ver, and iron mines in Mongolia. They have established telegraph wires and are instigating the Dalai Lama to impress on the Mongolian chieftians that Russian is a great Power. To check this Russian influence the Chinese Government has de- cided to increase its military force in the New Dominion at Ill, Urga, and Ulysautal, and also to operate the mines with Chinese funds only. Strict orders to that effect have already been issued. Moreover the Board of Commerce and the Board of War have dispatched deputies to various parts of Mongolia and Chinese Turkestan to investi gate the actual conditions.
Major Obapman's burly form is missing from camp this year, to the regret of most of the rankers, but Captain D. MacDonald (Taikoo) is perf rming the duties of Adjut- ant admirably.

When years of age, and now I am 54. quite a young man I had to walk with crutches or sticks. This went on for over three years, and since that time I have never been properly free from the rheum- atism, and Lever so free as I am at the present time, since using Doan's Pille,
During those 34 years I had several severe attacks of this terrible rheumatism. The one in October of 1897, when I was living in Wednesbury, was, I think, the severest attack I ever had, it kept me in my bed for 10 months, and I became as helpless as a new buin babe. I was at tended by one of the best doctors, but he siemed unable to do me much good, a'though he told me more than once that if I had been a millionaire he could not have trie harder-and I believe him,
