Two officers of the United States Army who have
resigned their commissions expect to serve in Chins. They are to receive high rank in return for introducing Western military methods.

The officers are First Lieutenant Honry L. Harris and Second Lieutenant Morton Russell, beth of the Twenty-second In- fantry. They wore stationed up to the time of their resignation at Camp Keithley, Mindanao, Philippino islande. Harris will' bo a Colonel and Russell a Major in the Chinese army, the former at 87000 and the latter at $5000
year. The negotiations
of the Peking government for their services were carried on through Consul-General Sa at Manila.
Llontenant Harris is a son of Ligutenant- Colonel Harris, retired, a native of New York and a West Point graduate, . He was 1378 appointed to a Second Lieutenanoy-in-
1899, and promoted the following your, Lieutenant Russell is a son of a Boston aboa manufacturer and was appointed Second L'eutebant in 1902. He is also a native of the Empire. State and began his military career as a privato in the Sixteenth Infantry.

In their freight cirqular, dated October 7 Messrs Lamike and Rogge state :-
The much-desired change for the better in regard to freights constwise has not made its apposmuce yet, fresh business has once more been on a vory minimal scale with rates 'remaining unprofitable. -Interest now centres in the possible results of the ratifi- cation of the peace treaty between Japan. and Russia which is roported to have just taken place. That, as a consequence of this "-event, the lethargy which has been dominat- ing the market for quite a while now will be removed to acnie extent, scoms certain onough, but the all-important question remains, will with such an abundance of tonnago about the improvement turn out. to be of much significance and last for any- appreciable length of time?
Saigon/Hongkong freights have continu. ́ed in a hføless condition during the period under review, the few steamers, owned by Chiueso and plying regularly between the two ports, picking up what cargo they could get on a basis of about 11 to 12 cents per picu!.
From Saigon to Philippines ports nothing has been doing quite lately, but some frcah demand is likely to be witnessed for ond of this month's loading.
A few inquiries for tourand Rad at. Saigon for Japan have been in the market, but offers of steamers in response thereto at a rate in the neighbourhool of 30 cents per picul have failed to even elicit a 'coun- terbid.
There has been no business from Saigon in other directions.
Quarantine restrictions at Saigon against arrivals from this port have in the mean. time been withdrawn by the French authorities.
· Newchwang-The price of beans and beancakes has of late receded to a normal lovel, and two charters, the first since the closing of last year's season are recorded from Nowchwang to Canton at 24 and 26 cents respectively. Unless produce for some reason or other will between now and the end of next month, when Now chwang will be ice-bound, be held at pro hibitive rates again, the fixtures above referred to may safely be predicted to be. como precursors of several further ones in same direction, w
Coal Freights-From Moji to this, a settlement is repor ed at 81.10 and from Moji for Amoy a steamer secured 82.25 for. a part cargo. Japan coal is in strong re- quest at ours at hardening rates, but the effect of floods and the inadequacy of trans- portation facilities from the mines, the Japanese Government still having most of the rolling stock of the railways under eng agement, form serious obstacles to trade.

On October 5, at Shanghai, Mr justice de Sauamarez sat in the Supreme Court to hear the case brought by Mears Dodwall and Co., Ltd., against Mr E. J. Moss.
Mr H. E. Pollock, K.C., and Mr R. N. Macleod appeared for the plaintiffs, and Mr Duncan McNeill and Mr Francia Ellis for the defendant.
An amended petition set out that in
an agreement made between George Ben- jamin Dodwell and Ernest Joseph Moss, carrying on business as Dodwell, Carlill and Co., st Foochow and elsewhere on the one part and the plaintiff company on the other it was agreed that G. B. Dudwell and E. J. Moss should as on January 1 1902, assign to the plaintiffs the goodwill of the business of Dodwell, Carlill and Co. Defendant was consequently paid £1000, and agreed not to carry on any business afterwards in competition with

This Association has been under fire in the public press during the last few months, but has hitherto remained silent. No doubt this silence has been interpreted by many as an admission of the truth of the state ments and charges therein made. Such an interpretation is incorrect. The failure to speak up to this time has beer partly due to the fact that many of the attacks have borne unmistakable marks of iusincerity. Defendant, in a re amended answer, ad. mitted the allegations, but said that up to the 14th June, 1905, he was carrying on busines as a merchant at Foochow in the Empire of China. Further, that the sum of £1,000 sterling was paid to him by the plaintiffs, but that such payment was made subject to certain stipulations entered into between the plaintiffs and the defen- dant. Subsequently to the above payment the plaintiffs demanded the repayment by the defendant of the said sum of £1000 and he, the defendant, agreed to repay the
