On May 2, Judge Owen, of the Barry Court, delivered a judgment in a test case which, in its importance to shipowners. stands on an equality with the case of the "Scarsdale." The question for decision.
was the legality of the Shipping Federation repatriation clause as used in ships' articles, by which the crew agree to be sent home to the nearest port in the United Kingdom, served by regular steamers, in the brunt of discharge abroad. This clause has for years been opposed by the Board of Trade, which has seldom fost an opportunity of interefer ing with its operation and using it as au instrument for croating friction between masters and their crews. In the present "Madawaska" case, the crew, having been engaged at Barry, were discharged at Bremerhaven, and sent thence by the owners to Grimsby, Thoy now claimed their fares from Grimsby to Barry. The Judgo decided as follows: The only ground put forward in Eupport of the plain-

may agree as to the port to which he is to be sent back when his voyage ends at a foreign port, he cannot do so at the time when he signs the articles of agreement for the voyage, as Section 188 of the Act only provides an agreement as to the port to which he is to be sent back being made at the time of his dischargo... Although “ Section 186 expressly allows auch an agree ment as is contained in the clause to be made at the time of a seaman's discharge, I do not find anything anywhere in the Act which prohibits such an agreement being made at the time when the articles are signed; and as there is not anything in the clause which is in itself contrary to law, and in the absence of any prohibition to such an agreement being made when the articles are signed. I think that the clause in question is legal and that it must be on- forced.

SAFETY OF AMERICAN LINES.
Recently we published a paragraph com- paring the English and American railway accident list, to the disadvantage of Amerios, An American friend now sends the following extract from an Ameriçan paper:-
While no passengers were killed on the 22,000 miles rails in 1991, it was not be- cause there were no accidents In that happy year passenger trains got together fty-five times and suffered sixty-five derailuients. Also there were twenty-nine collisions with buffer stops, and 176 per- - sons were injured in train accidents. For the same year, upon 14,000 miles of American line, moving 7,500,000 people. only nine lives were lost, which shows that we are also lucky-in spots.
Almost every American who can road has read about the English railways, with 22,000 miles of road, as against our 200,000, upon which no one was killed in 1901, but not many of you know that the Jast British report shows that there were 156 passengers killed and 3,413 injured 497 employes killed and 788 injured during | the year ending December 31, 1903. grand total of 1,242 killed and 18,557 injured you have not seen mentioned in any American magazine or newspaper, not oven by the secretary of the interstate commerce commission, who appears to liku long lists of kilted.'
The
In a single station in Boston 1,666 train movements are made from dawn to dawn. An American locomotive shuts off at the sight of danger with one movement of a throttle lover-quick as a pistol shot. - Au English driver closes his valves by grinding a wheel like an old-fashioned hand brake. presumo 90 per cent of our cars are equip- ped with quick action air brakes, while a like percentage of English carriages still carry An Eng. the slow-moving vacuum brake. lish driver drove his engine into the bum- ping posta in'n station, slaughtering sixteen persops. Westing-house air brakes would have saved these lives, even though the ab. sont-minded beggar ran wild almost to the last rail length, no light and easily hold are the English cars.
