IN CHINA,

An Epoch-Making Edict.

(BY A CORRESPONDENT TO THE STANDARD.} While everyone is discussing the advent of religious toleration in Russia, only the briefest notice his been taken of the aboli tion of torture in China, news of which has boon cabled from Peking; yet the one event is an epochmaking as the other. If one had to describe in precise language the difference between Western and Eastern civilisation, one would almost be reduced to the distine- tion that in the East criminals are still. tortured, in the West they are not. We have all, as nations, committed torturein our time, but when we adopted what is popul arly known now as Western civilisation we abolished the rack and the thumb scraw. In fact, the Middle Ages leave off at the precise point where it is considored legit- imate to maltreat a prisoner until he con fesses his crime.

In China, the old order still remains. Nothing can be more humane than the 1376 theory of Chinese justice; nothing more cruel than the practice. In theory, no man can be punished unless he confesses his guilt, and he must sign his own death- warrant. In practics, he is tortured until ho does confess, and then is punished for a crime which, in many cases, Le never com

nitted. The distinction between torturo and punishment is a fine one, and adapted to the subtlety of the Chinese intelligence. Not many months ago I went to call upon a Chinese judge at the place of justice. Ite was summer weather, and one side of the building was entirely open to the courtyard ́ through which one entered the building.

Have seen this happen in the native city of Shanghai, within a stone's throw of the foreign settlement with its western coles of justice. It is not clear whether the new edict does away with such minor exhibi- tions of cruelty. But to abolish the more hideous forms of punishment, and to re move the preliminary torture which makes capital punishment, when it comes, a relief these are innovations suflicient in them- selves to alter--the whole complexion_of_ Chinese society.
