The firm was an ordinary mercantile one, and possessed a private codo facilitating telegraphic business. At the end of the first year the balance sheet showed a loss, and the business was not being conducted to the satisfaction of the partners in Europe, They wrote to the defendant complaining of it and finally a writ way issued asking for the dissolution of the partnership. The plaintiff was employed by the firm as bookkeeper, and from September 1904 to January 10 he was employed by defendant to do extra work in connection with partners. This work kept plaintiff in the office until late at night, and entailed a considerable amount of labour. On several mocasions defendant told the plaintiff that he would be amly compensated for his trouble but that compesation had not been received. After the issue of the writ defendant set about the preparation of a new private code, so that in caso the firm was dissolved, he would be ready to recom- monce business with other partners. Un this work plaintiff and another man was employed, and all that plaintiff had receiv ad was about $100.
