The Chief Justice, Sir Lionel Cox, de- livered judgment yesterday afternoon in the Supreme Court in the case of Mr J. Clifford Wilkinson versus Mesars McAlister & Co., Singapore, says the Straits Times of Dec. 18. The plaintif applied to the Court for an injunction to restrain the defendants from using the word Tansan' in describing the Japanese mineral waters for which they act as agents. The judgment was in the following terms :-

In 1901 the plaintiff wrote to the defendants complaining that the sales had not increas- ed and informed them that he appointed. the Borneo Co. as his sole agents. In fact the company seeins to have taken up the agency somewhere in January, 1901, and Mr Frank Hilton says the sales have been considerable. He adds that he had novor heard of any other water being sold under the same name until Mr Stephens, manager of the defendant company, told him that he was going to run an opposi- tion Tansan.'

Plaintiff heard in Japan in the same year that Hasegawa & Co. were shipping water for Singapore under the name the of 'Fu- nagoya Tansan' and he wrote to his agents to tal proceedings. On 7th October. 1901, the defendants advortised in the local papers the Funagoya Tansan' which they admit had arrived for the first time in the pre- vious month. On 12th November plaintiff's- solicitors wrote to the defendants request- ing them to cease advertising and selling On the 13th under the name of Tansin. November defendants replied the word Tansan is generally used in Japan to denote mineral water and no ono has a right to ita and exclusive use. The plaintiff, who was still

in Japan, was informed of the defendant's. reply and by telegram instructed his agents to commence an action. The writ was issued on 19th December 1901.

Upon the evidence I have arrived at the conclusion that the labols produced by the dofendants really catne into use long after Wilkinson had adopted the word Tansan and by his oxertions and at great expense had made it known and valuable as a trade-mark.

For the plaintiff, Mr B. N. Chamberlain (author of Things Japanese') quoting from the standard Japanese dictionary, the Genkai, mys 'Tansan isdefined as achemi- cal term signifying a combination of carbon and oxygen. He has never heard it used as signifying generally mineral water. Captain Brinkley, editor of the Japan Afail, who has resided 3 years in Japan, and is the author in collaboration with Japanese professors of a dictionary now in its 5th edition, says 'Tansan means car- Sonic acid; the word is not in use among common people, being a scientific term. It would be quite absurd to say that Tan- ban-is a word well known as denoting gen. erally mineral water.

Sato Yutaro, formerly headmaster of the Commercial School, Kobe, says that Tan san is not a generic word applied to all mineral waters. Analogous evidence is given by other witnesses to whom it is not necessary to refer inore fully. Upon the whole case I find in favour of the plainti that the word Tansan is not a generic name for Japanese mineral water, but is of the nature of a fancy word not in com- mon use and one which could be lawfully adepted as a trade-mark.

But even if I had to find that in Japan the word Tansan is a descriptive ramo applied to mineral water generally, as is gateaded by the defendants, would have to hold also on the facts now before me that in Singapore it has acquired a secondary meaning and become so dis- tinctive of the plaintiff's goods that the use of it by the defendan's would have the effect of passing off their goods as the goods of the plaintiff The plaintiff has imported | his nineral water since 1893 under the name of Tansan; the other name Take- radzuka which also appeared on the label then used does not affect the question. The defendants imported the mineral water of Hasegawa & Co., under the mue of Funagoya Tansan for the first time in September, 1901, sometime after they had ceased to be the agents of the plaintiff and shortly before the commencement of this suit. The water imported by the plaintifï' has become known on the market as Tausau --plaintiff has produced old wine lists of Gosling & Co, who were formerly his agents and of the Hotel l'Europe, and of the Singpore Club, in which the Tansan is mentioned. It was ordered from the plaintif in Japan and it was invoiced by him to Singapore Tansan-it was advertised and sold as Tansan, I find upon the evidence that the word had come 10 mean Wilkinson's mineral water. could really mean nothing elso because there was no other water of the name on the market until the defendants brought in the Funagoya Tansan. Of course many people who bought Tansan may have been ignorant of the plaintiff's name. There is no doubt that a person looking at bottles with those respective labels can easily distinguish plaintiff's from defend- ants' bottles; but that is not a suflicient answer to the plaintiff's contention. The samo defence was considered and rejected by the Judicial Committee of the Privy Their Council in the Club Soda' case.
