ROCKLE ABOUT A SEA WALL.

In this action Chan Chin Hop. Teang Hot and Wong Kong sued Chan Fuk for $700 duusges suffered by the plaintiff through the breach by the defendants of a continet for the erection of sea wall.

The particulars of the olar were n follows: To six moms rest of ground at 870 per monil from Nov. 10, 1902, to May 10, 1003, 2420; To cost of palling down and erecting defective wall huile by de- fendants $280, total $:00.

Mr Goldring (of Messrs Doneon and Hastings) appeared for the plaintiffs, and Mr Grist (of Messrs Wilkinson and Grist) represented the defendant.

Mr Goldring said that the case was

all importance, such as, the settling of ütles, etc., sul not involving any large in terests in which the public of the Colony would be interested lowever, the pro gress of Hongkong has born exceptional and almost unique in the history of the Colonies of the Empire within the last few years, and the result has been that lains to land, which at the time that the Linds Title Commission was inaugurated (Before His Honors A. & Wier, Puiste were of little or no value, hava suddenly sprung into a valno of extremio greatness. The Ordinance, therefore, to which I rofer, No. 13 of 1903, was passed on August 18 st, and under the second section of that rdince the Chief Justice is empowered nuy tinns before the title han in pran under the principal Ordinance, if good use is clown by the Attorney General, give leave to appeal to the Full Court p any decision of the Land Court here- Sore made or hereafter wonde with regard ang land in the Now Territory. Under the Inw of the Colony, both by Pirtne of the Land Court Ordinance and the Convention of China, all the Nou Territory is the properis of the Crows, start, therefore, with that assumption, And the Crown is in this position that if as given by law, the right to certain per ions called claimants to establish if they an curtain claims to dispossess the owner, he Crown, of the land. The Crown was bot represented at the hearing of the case, is shown by the nfidavit of the Crown Solicitor which was filed yesterday. In the Erst paragraph he states that no notice wan Jeraived by the Crown of the hearing of the above claim in the land Court. The Crown had no notice and it was not repre- ented. Wo are not, therefore, liable to be charged with negligence or with atanding by and not appearing as we might have done at the Court. We had no notice

Mr Goldring-1 menut them to be cross of the hearing, and as a fact until it became Sapparent from certain decisions which rose His Honour exil that the defendant had -importar qublic questions it was no done some work, but niest of it was badl ver considered that the Crown should be that torbe pulled down. It was then represented. I do not say that the clai-arranged that the grid work was to be paid mants did anything out of the way by not for, but not the bad, giving notice, but say they cannot charge e with doing anything out of the way by not appearing at the Court. We appeal against the decision of the Court b fow on the grounds that the decision was erroneous on a questions of fact, list question being the cistrustion of the foreign law-the law of China. First of all the evidence adduced was fraudulent and we can establish tho allo otion.

Closure was aje died with six wickets down, and Chichester and Chesney, the latter howling very well indceil, disposed of the Gunners for 09. Had all the chances been accepted, the score would have been much smaller. Heath fielded exceptionally well at cover-point. The Gunners were sent in Scores:- a second time.

Mr Brutton argued that the practice huo has been to grant a receiving order if twa of the partner lave signed the petition. His Lordship-I cannot guarantee the decision of others. I au responsible for If you can show me sonic case it my oan. is all right.

Mr Bruco Shepherd--In the ether caure the partners had already absconded.

Dis Lordship-Some of the partners in this case zze living in Hongkong and there is nothing to say that notice of petition has hom served upon them to onable them to "ppose it.

Mr Brutton-They have all received justice,

His Lordship-It does not say so hore. Mr Brutton-I have a witness to give evylenes tlst they have had notice.
